대법원 2022. 7. 21. 선고 2017다236749 전원합의체 판결은, 동일인 소유이던 토지와 지상 건물이 매매 등으로 각각 소유자를 달리하게 되었을 때 건물 철거 특약이 없는 한 건물 소유자가 법정지상권을 취득한다는 관습법이 현재에도 여전히 법적 규범으로서 효력을 유지하고 있다고 하여 종래의 판례를 재확인하였다. 그러나 이에 대하여는 관습법상 법정지상권에 관한 관습법은 존재하지 않았거나 법적 확신을 상실하여 소멸하였고, 관습법상 법정지상권을 인정하는 것은 거래의 안전과 법적 안정성을 해칠 뿐만 아니라 거래비용을 증가시켜 사회 전체의 효율을 떨어뜨린다는 김재형 대법관의 반대의견이 있었다. 그리고 다수의견에 대한 보충의견은 특히 법적 안정성을 위하여는 판례 변경은 신중해야 한다는 점을 강조하였다.
이 글은 위 판결에 대한 평석이다. 필자가 보기에는 관습법상 법정지상권이라는 관습은 원래 존재하지 않았는데, 조선고등법원 판례가 만들어낸 것이고, 그에 대한 법적 확신도 존재하지 않는다. 이 문제에 대하여 견해를 발표한 대다수의 법률가와 법학자들이 관습법상 법정지상권에 관한 판례는 타당하지 않다고 비판하였다. 또 법경제학적인 관점에서 보더라도 토지와 그 지상 건물의 소유자가 달라지게 된 원인이 매매나 증여와 같이 당사자의 의사에 기한 경우에는 거래비용이 작으므로 구태여 법원이 개입하여 관습법상 법정지상권을 인정할 필요가 없다. 다만 토지와 건물의 소유자가 달라지게 된 원인이 강제경매 또는 국세징수법상의 공매와 같이 당사자의 의사에 기한 것이 아닌 경우에는 법정지상권을 인정하는 것이 합리적이다.
그리고 이 경우에는 관습법상 법정지상권을 인정하는 판례에 대한 구체적인 신뢰가 존재한다고 볼 수도 없으므로, 판례 변경을 주저할 이유가 없다.
The Supreme Court en banc Decision 2017Da236749 dated on July 21, 2022 held the precedent of the customary legal superficies, which recognizes that the owner of a building acquires statutory land rights unless there is a special agreement to demolish the building when the land and the building above the land belonging to the same owner are sold or otherwise transferred to different owners remains the legal norm. However, there was a dissenting opinion by Supreme Court Justice Kim Jae-hyung, who argued that he customary legal superficies either did not exist or was extinguished due to the loss of opinio juris(opinio necessitatis), and that recognizing the customary legal superficies would not only harm the safety and legal stability of transactions, but also increase transaction costs and reduce the efficiency of society as a whole. The supplementary opinion to the majority opinion emphasized that changes in precedent should be made with caution, especially for the sake of legal certainty.
This article is a commentary on the above judgment. In my view, the customary legal superficies did not exist in the first place, but was created by the Japanese High Court of Choson, and there is no opinio juris about it. The vast majority of lawyers and jurists who have commented on the issue have criticized the common law jurisprudence on statutory easements as untenable. Also, from the point of law and economics, if the cause of the change in ownership of the land and the building on the land is due to the voluntary transaction of the parties, such as a sale or a gift, the transaction cost is small, so there is no need for the court to intervene and recognize the customary legal superficies. However, if the cause of the change in ownership of the land and the building is not due to the voluntary transaction of the parties, such as a forced auction or public sale under the Tax Collection Act, it is reasonable to recognize statutory land rights.
And in this case, there is no specific reliance on the precedent of the customary legal superficiescommon law cas, so there is no reason to hesitate to overrule the precedent.
