노동조합 및 노동관계조정법은 헌법상 노동3권을 실질적으로 보장하고 노사관계의 질서를 신속하게 정상화하기 위한 목적으로 제81조 이하에서 부당노동행위 제도에 관하여 규정하고 있다. 사용자에 의한 부당노동행위에 대한 구제방법으로는 ① 침해된 단결권상 이익의 원상회복을 목적으로 하는 행정적 구제제도, ② 부당노동행위에 의한 구체적인 권리·의무관계를 확정하거나 손해배상을 통해 단결권 침해에 따른 손실을 보전하는 민사적 구제제도, ③ 부당노동행위를 사전적으로 예방하고, 사후적 법익침해에 대해 형벌을 과하는 형사처벌 제도 등이 있다.
부당노동행위에 대한 공법적인 개입은 노동위원회에 의한 행정적 구제절차와 법원에 의한 형사절차로 이루어지는데, 노동위원회나 법원이 부당노동행위 인정에 엄격하고 소극적이라는 비판이 줄곧 제기되어 왔고, 이는 행정적 구제절차의 실효성 확보방안과 아울러 형사처벌 제도의 존치 필요성에 대한 논의로 전개되고 있다.
특히 지배·개입 부당노동행위에 대하여 ‘실질적 지배력’을 가진 원청의 사용자성을 인정한 대법원 2010. 3. 25. 선고 2007두8881 판결을 필두로 하여 원청이 하청업체 소속 근로자들로 구성된 노동조합에 대하여 단체교섭 의무를 부담함으로써 단체교섭 거부·해태의 부당노동행위 주체가 될 수 있는지 등에 있어서 ‘실질적 지배력’이라는 구성요건의 추상성, 불명확성 등으로 인해 형사처벌이 타당한지 여부에 대한 의문도 제기된다.
이 글에서는 부당노동행위의 구제절차에 관해 주요하게 논의되는 쟁점으로서 1) 행정적 구제절차와 형사책임에서의 각 주체, 2) 부당노동행위 의사와 증명책임, 3) 형사처벌 제도의 필요 여부에 관해 법률의 규정, 학계의 견해, 대법원 판례 등을 정리하고, 검토해 본다. 나아가 부당노동행위 제도의 개선을 위한 방안들을 살펴보고자 한다.
The Trade Union and Labor Relations Adjustment Act stipulates the unfair labor practice system under Article 81 for the purpose of substantially guaranteeing the three labor rights and quickly normalizing the order of labor relations. Remedies for unfair labor practices include an administrative remedial system designed to restore the infringed right to unity, a civil remedial system that determines specific rights and obligations caused by unfair labor practices or compensates for damages, and a criminal remedial system that prevents and punishes unfair labor practices.
Public intervention against unfair labor practices consists of administrative remedy procedures by the Labor Relations Commission and criminal procedures by the court, which have been criticized for being too strict and passive in recognizing unfair labor practices. In this context, the debate on the effectiveness of administrative remedies and the need for the maintenance of the criminal penalties take place.
In particular, the Supreme Court's Decision 2007Du8881 decided on March 25, 2010, which recognized the prime contractor’s status as an employer with “actual dominance” over unfair labor practices, raises the question of whether the prime contractor should also be subject to collective bargaining with a subcontractor’s labor union. Questions are also raised as to whether criminal punishment is appropriate due to the abstraction and uncertainty of the constituent requirements of “actual dominance”.
The main issues discussed in this article are the subject of unfair labor practices, the employer’s intent of unfair labor practices, and the burden of proof, whether a criminal penalty system is necessary, and measures to improve the unfair labor practices system.
