강력한 권력집중형 대통령제와 중앙집권적 권력구조로의 정부형태 선택으로 인한 폐단이 우리 지방자치의 비효율성으로 나타나면서, 실효성 있는 지방자치와 지방분권이 요구되고 있다. 2018년 국회 헌법개정특별위원회 자문위원회 헌법개정안에서 첫째, 중앙정부 내에서의 강력한 대통령 중심의 권력을 내각으로의 분산을 통한 분권형 권력구조의 구성, 둘째, 중앙집중형 권력구조로 인한 중앙정부로 집중된 정부의 권한의 지방자치단체로의 이양 등 두 가지 큰 방향에서 지방분권형 헌법개정이 추진되어왔다. 지방분권형 개헌안에서의 지방분권의 한계는 주로 중앙정부 권력의 지방자치단체장으로의 위임의 측면에서 지방분권형 헌법개정이 추진되어 온 결과, 지방의회의 기능과 권한의 강화는 헌법개정의 내용에서 배제되어왔다는 점이다.
지방자치의 효율성 달성을 위하여 그동안 지방자치단체장을 중심으로 논의되어 온 지방분권정책의 방향을 지방자치단체 내에서의 권력구조의 ‘견제와 균형의 원리’의 실현을 포함하여 고려할 필요가 있다. 지방자치단체장에 대한 실질적 견제를 위한 지방의회의 기능과 권한의 강화는 ⅰ) 자치입법권 강화를 위한 정책형성권의 범위를 확대, ⅱ) 실효성 있는 행정사무 조사·감사권 행사, ⅲ) 자율적 자치조직권 및 독립적 예산편성권 등을 명확히 법률사항으로 보장함으로써 가능할 것이다. 향후 지방자치단체장과 지방의회의 기관대립형 지방권력의 분권형 개헌으로 방향을 맞추어 나갈 필요가 있다. 현재 지방분권형 개헌이 어려운 상황을 고려할 때 「지방의회법」 제정이 대안이 될 수밖에 없을 것이다.
본 논문에서는 지방의회의 기능과 권한을 제약하는 「헌법」과 「지방자치법」상의 원인과 지방의회의 기능과 권한의 확대를 위한 「헌법」과 「지방자치법」상 국내 법제도로 도입가능한 제도적 대안을 분석하여 지방자치단체와 지방의회의 ‘견제와 균형의 원리’ 실현이 가능한 법제도적 개선방안을 제시하고자 한다.
Until now, the importance of actual local autonomy and decentralization has emerged as the inefficiency of Korean politics due to the strong power-intensive presidential system and the centralized power structure. Recently, decentralized constitutional amendment has been promoted in terms of strengthening decentralization through substantial local autonomy guarantee and significant transfer of central government power to provinces.
The limitation of decentralization in the decentralized constitutional amendment bill has been mainly in terms of delegation of central government power to local government, and local council has been excluded from the constitutional amendment.
In order to achieve the efficiency of local autonomy, the direction of decentralization policy, which has been discussed around the representative of a local government, must be considered, including the realization of the "principle of checks and balances" of the power structure within local governments. By expanding the scope of policy-forming right, which are key contents of strengthening the autonomous legislative power of local councils, and exercising administrative investigation and audit right of local government policie, it will be possible to realize the "principle of checks and balances" for local government.
In the future, it is necessary to revise the Constitution as a decentralized constitutional amendment of local power that checks each other between the local government and local council.
Considering the current difficulty of constitutional amendment, the enactment of the Local Council Act will inevitably be an alternative.
This paper analyzes the limitations of the Constitution and the Local Autonomy Act, which restrict the function and role of local council, and I would like to propose an institutional alternative that can be introduced into the domestic system under the Overseas Constitution and the Local Autonomy Act.
