죄형법정주의의 명확성원칙은 처벌법규에 대한 통상의 해석방법에 의하여 건전한 상식과 통상적인 법감정을 가진 사람이 당해 처벌법규의 보호법익과 금지된 행위를 알 수 있을 것을 요구한다. 헌법합치적 법률해석의 원칙은 어떤 법률이 한 가지 해석방법에 의하면 헌법에 위배되는 것처럼 보이더라도 다른 해석방법에 의하면 헌법에 합치하는 것으로 볼 수 있을 때에는 헌법에 합치하는 해석방법을 택해야 한다는 것이다. 논리적으로 어떤 형벌규정이 명확성원칙에 위배될 경우 법관은 해당 형벌규정에 대하여 헌법합치적 법률해석을 시도할 것이 아니라 위헌제청을 고려해야 한다. 그러나 헌법재판소가 이미 해당 형벌규정이 명확성원칙에 위배되지 않는다는 결정을 하였고 선례 변경을 기대하기 어려운 경우, 그럼에도 해당 형벌규정의 해석·적용이 기본권을 과도하게 제한한다는 의심이 있는 경우, 법관은 헌법합치적 법률해석을 시도함으로써 해당 형벌규정의 특정한 해석이 가져올 위헌적 결과를 배제하여 기본권 보장의무를 이행해야 한다.
형법 제314조 제1항이 정한 위력에 의한 업무방해죄에 대하여는 죄형법정주의의 명확성원칙에 위배된다는 비판이 지속적으로 제기되어왔다. 헌법재판소는 위력 요건에 관한 법원의 해석을 고려할 때 해당 규정이 명확성원칙에 위배되지 않는다는 결정을 네 차례에 걸쳐 하였다. 그럼에도 여전히 형법 제314조 제1항이 정한 구성요건, 특히 위력 개념은 법원의 해석에 의하여도 건전한 상식과 통상적인 법감정을 가진 사람이 금지된 행위가 무엇인지 알기 어려워 죄형법정주의의 명확성원칙에 위배된다는 심각한 의심이 제기된다. 또 법원이 특정한 사안에서 문제 된 행위의 기본권 관련성을 간과하여 헌법합치적 법률해석을 시도하지 않고 기존의 위력 판단 기준을 그대로 적용할 경우 피고인의 기본권을 과도하게 제한하여 과잉금지원칙에 위배된다는 의심이 제기된다.
법관은 구체적 사안에서 위와 같은 의문이 제기되는 경우 기본권을 보장하기 위하여 위력 여부의 판단 과정을 더 구체적으로 논증함으로써 죄형법정주의의 명확성원칙의 요구를 실현하여야 하고, 특히 최고법원인 대법원은 하급심 단계에서 제기되는 위력 요건 판단에 관한 법적 의문을 해소해 주어야 한다. 피고인의 헌법상 기본권 행사가 위력에 의한 업무방해죄의 위력에 해당할 여지가 있는 사안이라면 법관은 과잉금지원칙을 적용하는 헌법합치적 법률해석으로 헌법상 기본권과 위력에 의한 업무방해죄의 입법 목적이 조화롭게 실현될 수 있는 경계선을 발견함으로써 위 형벌규정이 기본권을 과도하게 제한하지 않도록 해야 한다. 이 경우 위력에 의한 업무방해죄 규정의 역사적, 체계적 해석상 위력 요건을 제한적으로 해석할 것이 요구된다.
In logic, if any punishment provision is in violation of the principle of clarity, the judge should not rush into Constitution-conforming interpretation but should instead defer to the Constitutional Court for the adjudication on the unconstitutionality of the provision at dispute. However, in cases where the Constitutional Court has already decided that the relevant punishment provision is not a violation of the principle of clarity, and it is difficult to expect a change of precedent, the judge should fulfill the obligation to guarantee fundamental rights through Constitution-conforming interpretation of statutes.
There has been a criticism that the crime of interference with business by the threat of force in Article 314(1) of the Criminal Act violates the principle of clarity. The Constitutional Court of Korea has repeatedly ruled that the interference with business by the threat of force under the Criminal Act does not violate the rule of clarity related to the principle of nulla poena sine lege. Nevertheless, serious doubt that the provision, especially the term “threat of force” violates the principle of clarity still remains. In addition, if the court overlooks the relevance between the act in question in a specific case and fundamental rights and applies the existing standards for determining the “threat of force,” the court, by doing so, may excessively restrict the fundamental rights of the defendant and violate the principle of proportionality.
In a case where the above concern arises, a judge should argue in more detail the process of determining the “threat of force” in order to guarantee fundamental rights. In particular, the Supreme Court should resolve legal questions regarding the determination of the fulfillment of the threat of force requirement that arise at lower court levels. If the defendant’s exercise of fundamental rights is likely to constitute a threat of force, the judge should find a boundary where fundamental rights under the Constitution and the legislative purpose of the crime of interference with business by the threat of force can be harmoniously achieved through Constitution-conforming interpretation of statutes by applying the principle of proportionality. It must be ensured that the above punishment provision does not excessively restrict fundamental rights.
