21세기 이미 도래한 디지털 사회에는 새로운 변화에 적합한 게임, 경쟁, 시장의 룰이 확립되지 않았다. 따라서 디지털 사회와 시장에서 공정성이 확보되지 못한 사례가 발생하고, 국민은 이러한 불공정에 반응하여 더욱 공정성이 확보되는 경쟁과 시장을 원하고 있다.
이 논문에서는 법철학적・헌법적 연구를 통하여 공정의 개념을 “확립된 헌법적 가치 중 직업의 자유와 실질적인 자유・평등, 법치주의에 입각한 규범들이 사회생활과 시장경쟁, 그리고 선거에서 시작에서 결과까지 실질적인 적법절차에 따라 준수되는 상태”라고 정의했다. 미국 헌법에서도 적법절차, 평등 보호, 소급처벌 금지(Ex Post Facto), 이중위험 금지(Double Jeopardy)의 원리를 통하여 헌법상 공정의 원칙을 도출한다. 그리고 이러한 공정의 원칙은 자유시장의 경쟁에서 더욱 준수될 것이 요구되기 때문에, 디지털 시장에서의 합리적인 규칙을 만들고 이를 준수함으로써 공정성의 확보가 필요하다.
디지털 사회에서 공정이 확보되지 못한 이유는, 새로운 디지털 시장에서 합리적인 규칙이 형성되지 못하는 동안 디지털 기업이 독점을 형성하기 때문이다. 디지털 영역에서도 실질적 자유, 평등이 보장되고 실질적 적법절차가 구현되는 합리적인 규칙과 운영질서를 만들고 운영하기 위해, 종래 공정거래법은 물론 인공지능의 윤리와 법 규제, 알고리즘의 규제, 데이터의 편향성 해결 등이 검토 과제로 부상된다.
데이터 시대에 공정성을 확보하기 위해서, 실질적 평등을 추구하는 헌법 제11조, 그리고 경제상의 자유와 창의를 존중하고 개인과 기업의 경제상 자유와 창의를 존중하는 제119조를 통하여 공정의 개념은 확립하고, 이러한 공정을 우리 사회의 출발선에서 그 과정과 결과에까지 공정성과 투명성이 확보되도록 할 필요가 있다. 그리고 데이터 기업의 불공정에 대하여 법적으로 대응함은 물론 신입법으로 대응할 필요성도 진지하게 검토하고 추진해야 한다. 윤리와 정의, 공정이 없는 지능은 지능이 아니며, 인공지능에 이러한 가치를 구현하기 위한 절차와 제도가 요구된다. 드워킨이 지적한 것처럼 출발 전부터 자원의 평등은 중요하며, 디지털 플랫폼에도 평등한 조건과 공정한 상태를 만들려는 헌법적 노력과 관련 입법적 검토는 계속되어야 한다.
In the digital society of the 21st century, rules for games, competition, and markets suitable for new changes have not been established on the online. Therefore, there are cases where fairness is not secured in the digital society and markets, and the public is responding to this unfairness and wants more fair competition and markets.
This paper, grounded in legal philosophy and constitutional research, defines the concept of fairness as “Among the established constitutional values in social life, market competition, and elections, freedom of occupation, substantive freedom and equality, and norms based on the rule of law, are observed in accordance with substantive due process from beginning to end.” The U.S. Constitution also derives principles of constitutional fairness through the principles of due process, equal protection, Ex Post Facto, and Double Jeopardy. As these principles are imperative in market-like competition, it becomes essential to formulate reasonable rules in the digital market and ensure compliance for a fair outcome.
Fairness has not been secured in the digital society, because digital companies monopolize the market without the establishment of reasonable rules in the new digital market. To rectify this, the creation and implementation of reasonable rules and operating orders that guarantee practical freedom and equality are vital in the digital realm. This necessitates considerations beyond existing antitrust laws, encompassing ethics, legal regulations of artificial intelligence, algorithmic regulation, and resolution of data bias.
In the data era, fairness is anchored in constitutional principles, notably Article 11's pursuit of substantive equality and Article 119's respect for economic freedom and creativity. There is a pressing need to ensure transparency and fairness throughout societal processes, from inception to results. Addressing the unfair practices of data companies requires not only legal responses but also the enactment of new laws. Intelligence devoid of ethics, justice, and fairness is incomplete, emphasizing the perpetual requirement for systems and procedures that embody these values in artificial intelligence. As Dworkin emphasizes, equality of resources is paramount even before commencement, necessitating constitutional efforts and legislative reviews to create equitable and fair conditions on digital platforms.
