과잉금지원칙은 입법을 포함한 공권력행사의 합헌성 여부를 판단할 때 헌법재판소나 대법원과 같은 헌법재판기관이 사용하는 심사기준이다. 과잉금지원칙의 내용을 이루는 하위 원칙으로는 목적의 정당성, 수단의 적합성, 침해의 최소성, 법익의 균형성의 4가지가 있다. 과잉금지원칙은 독일에서 주로 연방헌법재판소에서 위헌심사기준으로 사용되고 발전되었다.
헌법재판소는 과잉금지원칙의 헌법적 근거로 대부분의 판례에서 헌법 제37조 제2항을 들고 있다. 그러나 헌법 제37조 제2항은 전통적인 헌법해석방법인 문구해석, 체계적 해석, 역사적 해석, 목적론적 해석에 따를 때 과잉금지원칙의 근거로 볼 수 없다는 것이 필자의 생각이다.
과잉금지원칙의 헌법적 근거는 무엇보다도 법치국가원리(법치주의)에서 찾아야 한다. 법치국가원리는 국가의 기능 내지 행위를 일반적으로 규율하는 원리이다. 그렇다면, 과잉금지원칙은 이와 같은 법치국가원리에 자명하게 내포된 헌법원칙으로서 기본권제한의 헌법적 정당성을 확인하여 국가행위를 통제하는 심사기준이다. 또한 과잉금지원칙은 개별 기본권의 특성에 따라 적용여부가 결정된다.
The Prohibition of Excessive Restriction Principle (hereinafter referred to as “the Proportionality”) is a standard used by constitutional bodies such as the Korean Constitutional Court (hereinafter “the C.Court”) and the Korean Supreme Court (hereinafter “the S.Court”) to assess the constitutionality of the exercise of governmental power, including legislation. The Proportionality comprises four sub-principles: Legitimate Legal Objective, Adequate Means, Minimal Impairment, and Balancing of Personal and Public Interests. The Proportionality has been developed and used as a reviewing standard by the German Federal Constitutional Court.
The C.Court predominantly cites Article 37(2) of the current Constitution of Korea (hereinafter “the Constitution”) as the basis for the Proportionality in its rulings. However, according to traditional constitutional interpretation methods, which include literal, systematic, historical, and teleological interpretations, Article 37(2) of the Constitution cannot serve as the constitutional basis for the Proportionality.
Primarily, the constitutional foundation for the Proportionality should be located in the Rule of Law. The Rule of Law is a principle that generally governs the actions and functions of the state. Thus, the Proportionality is a constitutional principle inherently embedded in the Rule of Law and serves as a standard for evaluating the constitutional legitimacy of state actions and regulating them. Furthermore, the applicability of the Proportionality is determined by the characteristics of individual basic rights.
