시장지배력 전이 이론을 단순히 남용행위가 발생하는 시장과 경쟁제한 효과가 발생하는 시장이 서로 다를 수 있다는 의미로 이해하는 경우에는 이를 부정하는 견해를 거의 찾아볼 수 없으며, 시장지배적 지위 남용 사건의 부당성 판단기준을 제시한 포스코 판결 역시 그러한 의미에서는 시장지배력 전이 이론을 수용한 것으로 볼 수 있다. 그러나 시장지배력 전이 이론을 이와 같이 좁게 이해한다면, 동 이론은 포스코 판결의 부당성 판단기준과 구별되는 독자적인 의미를 가질 수 없게 되고 그 결과 시장지배적 지위 남용 사건의 부당성 판단에서 그 유용성을 인정받기 어려울 것이다.
EU에서는 시장지배적 사업자의 ‘특별책임’을 인정하는 전제에서 시장지배적 지위가 인정되지 않는 시장에서 남용행위가 발생하고 그로 인한 경쟁에 대한 해악이 발생하더라도 양 시장 사이에 긴밀한 관계가 인정되는 특별한 사정이 있는 경우에는 TFEU 제102조 위반을 인정한 사례들이 있는데, 티브로드 강서방송 사건이나 SKT 멜론 DRM 사건 등에서는 이러한 EU 법상의 지배력 전이 법리를 원용하려는 시도들이 있었다. 한편 미국에서는 시장지배력 전이 이론이 독점화 또는 독점화 기도 행위를 규제하는 셔먼법 제2조 위반의 경쟁제한성 판단 기준을 다소 완화하는 이론으로 원용된 바가 있는데, 우리나라에서는 최근의 네이버쇼핑 사건 등 자사우대 사건과 관련하여 이러한 의미의 시장지배력 전이 이론을 원용하여 포스코 판결에서 판시한 부당성 판단기준을 다소 완화하여 적용하려는 시도가 이루어졌다. 그러나 우리 대법원이 시장지배적 사업자의 지위남용 행위와 경쟁제한 효과 발생 사이에 인과관계를 요구하였다고 볼 수 있는 점, 남용행위가 발생한 시장과 경쟁제한 효과가 발생한 시장이 서로 다른 경우라고 하여 포스코 판결에서 제시된 부당성 판단기준을 완화하여 적용하여야 할 특별한 이유를 발견하기 어려운 점 등을 고려하여 볼 때, EU에서 인정되는 지배력 전이 법리 또는 미국에서 한 때 하급심 판결에서 수용되었던(그러나 지금은 사실상 폐기된) 지배력 전이 법리를 우리나라 시장지배적 지위 남용 사건에서 원용하는 것은 타당하지 않다고 생각한다.
요컨대 시장지배력 전이 이론은 이를 어떤 내용으로 이해하더라도 우리 공정거래법 상 시장지배적 지위 남용 사건에서 특별한 유용성을 인정하기 어려운 이론이라고 보아야 할 것이다.
The theory of monopoly leveraging suggests that a company's dominant position in one market can extend to another. According to this theory, a company with market power can engage in abusive practices that restrict competition in other markets as well. However, a narrow interpretation of this theory diminishes its distinct significance from the standards of unfairness set forth in the POSCO decision.
In the European Union (EU), the ‘special responsibility’ of dominant market players is recognized. Even if abusive practices occur in a market where dominant status is not established and result in competitive harm, EU law has acknowledged violations of Article 102 of the TFEU in cases where there is a close relationship between the markets under specific circumstances. Attempts to apply EU law's transference of dominance in cases like the T-Broad Gangseo Broadcasting case or the SKT Melon DRM case have been made. Meanwhile, in the United States, the theory of monopoly leveraging has been used to somewhat relax the criteria for assessing anticompetitive behavior under Section 2 of the Sherman Act, which regulates monopolization or attempted monopolization. In South Korea, recent cases like the Naver Shopping incident have seen attempts to apply this theory in a similar vein, moderating the standards of unfairness established by the POSCO decision. However, considering that the Supreme Court of South Korea requires a causal link between the abusive conduct of a dominant market player and the occurrence of anticompetitive effects, and the difficulty in finding special reasons to moderate the standards set by the POSCO decision when the market of abuse and the market where competitive harm occurs are different, it seems inappropriate to apply the monoply leveraging theory recognized in the EU or the once-accepted (but now largely discarded) U.S. principles in South Korean cases of abuse of dominant market position.
In conclusion, regardless of how the theory of market dominance transference is understood, it appears to be a theory of limited practical use in cases of abuse of dominant market position under South Korean Fair Trade Law.
