초상권 보호의 주된 근거로서는 인격적 표상에 대한 인격 주체의 자기결정권 보호와 사생활의 비밀과 자유 보호의 두 가지 관점이 제시되고 있다. 그런데 인격 주체가 스스로 공공 일반에 자신을 드러내기로 결심한 이상, 공적 영역에서 그의 일상생활 모습을 관찰하거나 이를 촬영하는 것은 피촬영자의 자기결정권에 대한 위법한 침해로 볼 수 없다. 그리고 공적 영역에서 타인의 일상생활 모습을 촬영하여도 애초 피촬영자인 인격 주체가 스스로 외부로 드러낸 것보다 더 많은 것이 외부로 공개되는 것은 아니어서 이러한 촬영으로 피촬영자의 사생활이 침해되는 것도 아니다. 공적 영역에서의 일상생활 모습을 촬영한 결과물을 배포하는 행위는 피촬영자의 자기결정권에 대한 침해가 될 여지가 있으나, 공유하는 공간으로서의 공적 영역의 특수성이나 촬영자의 인격성 내지 정체성 형성 및 유지의 자유, 표현의 자유 등의 보호와의 관계에서 적법한 것으로 보아야 한다. 이와는 다르게 공적 영역에서 사고를 당하거나 곤경에 처해 있는 모습 등을 촬영・배포하는 경우에는 인격권의 핵심적 보호영역에 해당하는 긴밀한 사적 영역에 대한 침해에 해당할 여지가 높아지고, 동시에 그러한 행위에 대한 형법적 대응의 필요성이 높아지게 된다.
This article examines the legal responses within criminal law to the act of photographing individuals in public spaces without their consent. The theoretical basis presented for the protection of the photography subjects hinges on two grounds: preserving an individual's right to self-determination and safeguarding the secrecy of private life. Merely observing or photographing a person's outward appearance when they willingly disclose themselves to the public does not inherently infringe upon their right to self-determination. Furthermore, capturing a portrait of someone in a public domain typically reveals no more than what the individual has already exposed to the external world, thus not constituting a breach of their privacy. Nevertheless, even within the public sphere, the unauthorized capturing or dissemination of images depicting inviolable private sphere of life may incur more extensive criminal penalties.. For instance, incidents such as the Halloween tragedy in Itaewon in 2022 underscore the need for legal measures to criminalize the taking and distribution of images that could cause significant harm to victims or their families.
