민사집행법은 보전처분에 대한 인가결정이 확정된 이후 동일한 보전처분에 재이의신청이 제기된 경우의 처리 방안에 대하여 명시적으로 규정하고 있지 아니하다.
이 경우 재이의신청의 허용 여부에 관하여 하급심 실무는 첨예하게 대립하고 있는데, 이에 대한 대법원 판례는 존재하지 아니한다. 제1설에 따른 실무는 이의사유를 불문하고 언제나 재이의신청에 따른 후행 이의절차 개시가 불가능하다고 보고 있다. 반면, 제2설에 따른 실무는 선행 이의절차에서 심리된 이의사유로는 재이의신청에 따른 후행 이의절차 개시가 불가능하나, 심리되지 아니한 이의사유로는 재이의신청에 따른 후행 이의절차 개시가 가능하다고 보고 있다.
확정된 인가결정에는 형식적 확정력이 발생하고, 민사집행법 조문은 취소절차와 달리 이의절차에서는 이미 존재하는 인가결정의 효력을 배제시킬 수 있는 문언을 포함하고 있지 아니하므로, 그럼에도 재이의신청을 허용한다면 동일한 보전처분에 대하여 인가결정과 취소결정이 공존하는 모순된 상황이 발생할 수 있다.
또한 이의절차는 보전처분 단계의 심급을 속행하는 절차로서, 확정된 인가결정에 의하여 보전처분 단계의 심급이 종료되었음에도 동일 심급을 수회 재개할 수 있도록 허용하는 것은 보전재판의 잠정적인 성격을 감안하더라도 부당하다.
따라서 민사집행법은 보전처분에 대한 인가결정이 확정될 때까지 1회에 한하여 채무자에게 보전처분 단계의 심급 속행을 구할 수 있는 이의신청권을 부여하였다고 보아야 하고, 위 인가결정이 확정되는 순간 그와 같은 절차적 권리인 이의신청권은 소멸한다고 봄이 타당하므로, 제1설의 결론을 지지한다.
The Civil Execution Act does not explicitly stipulate how to deal with cases where an re-objection is filed against a preservative disposition after a decision to approve the said preservative disposition has been confirmed.
In this case, the lower courts are sharply divided over whether or not to allow the filing of a re-objection, but there is no Supreme Court precedent on this. The practice following the first theory argues that it is absolutely impossible to initiate a re-objection procedure regardless of the reasons for re-objection. The practice under the second theory asserts that it is impossible to initiate a re-objection procedure on account of the reasons that have been heard in the preceding objection procedure, but it is possible to initiate a re-objection procedure based on the reasons that have been unheard in the preceding objection procedure.
A formal conclusive power arises from a final and conclusive decision to approve a preservative disposition. And unlike the revocation procedure, the Civil Execution Act does not contain provisions to preclude the effect of the decision to approve a preservative disposition in force. If the filing of a re-objection is admitted, a contradictory situation may arise in which the decision to approve a preservative disposition and the decision to cancel the same preservative disposition exist simultaneously.
Furthermore, an objection procedure functions as a process which resumes the stage of proceedings for preservative dispositions. Even considering the interim nature of the adjudication of preservative dispositions, it is still inequitable to allow the resumption of the stage of proceedings for provisional dispositions multiple times despite the termination of the said procedure based on the final and conclusive decision to approve the preservative disposition.
Therefore, it should be considered that the Civil Execution Act granted the debtor the right to file an objection to seek the progress of the stage of proceedings for preservative dispositions only once until the decision to approve a preservative disposition becomes final and conclusive, and it is reasonable to assume that the right to file an objection as a procedural right expires as soon as the above decision is confirmed. This paper is in support of the conclusion of the first theory.
