‘우주안보’(space security)란 어떠한 간섭이나 방해 없이 우주를 이용하고 우주로 접근할 수 있으며, 지구상의 안전 보장을 위해 우주를 이용할 수 있도록 하는 모든 기술적, 규제적, 정치적 수단들의 총합인데, ‘우주전쟁’(space war)에 대한 우려나 우주 군사 작전에 대한 대비 및 우주무기에 대한 규율을 넘어서 시민의 일상생활과 직접적으로 밀접하게 연관된 우주자산에 대한 사이버 공격이나 테러의 위험에 이르기까지 그 양상이 넓고 다양해졌다.
러시아와 중국은 ‘우주의 무기화’(weaponization of outer space)와 관련하여 이 문제에 대응하기에는 1967년 우주조약(OST)이 허점이 많아 우주에서의 군비경쟁방지(PAROS)를 위해 법적 구속력 있는 새로운 국제조약인 “우주 공간에서의 무기 배치, 우주물체에 대한 무력 위협 또는 무력사용 방지에 관한 조약안”(2008 PPWT)과 그것의 새로운 버전인 “우주 공간에서의 무기 배치, 우주 물체에 대한 무력 위협 또는 무력사용 방지에 관한 조약안”(2014 PPWT)의 채택이 필요하다고 주장하고 있다. 그러나 미국은 PPWT에 관하여 아직 우주 공간에서는 군비경쟁이 일어나지 않았기 때문에 군비통제로 해결할 문제는 없다고 하면서, PPWT에는 위협(threat)에 대한 정의도 없고, PPWT가 “군사적 이점을 얻기 위한 러시아와 중국 두 나라의 외교 책략”이라고 비난하고 있다.
사실 우주의 무기화를 규제하기 위해 법적 구속력이 있는 경성법인 조약을 채택해야 한다는 경성법 지지자들의 의견은 맞는 말이지만, 1979년 달협정(MA) 이후 조약제정이 어려워진 현시점에서는 우주 공간의 이용과 관련된 모든 측면에 대한 통합되고 구속력 있는 법적 도구의 궁극적인 생성을 위한 잠정적 조치인 연성법을 개발하여 국가들의 참여를 독려하는 방법도 좋을 듯하다. 그러한 면에서 2022. 12. 7. 유엔총회가 채택한 “파괴적인 직접 상승(DA) ASAT 테스트”를 수행하지 않도록 장려하는 결의안(A/RES/77/41)은 좋은 모델이다.
Space security is the sum of all technical, regulatory, and political measures to enable use and access to space without any interference or interference, and to use space to ensure safety on Earth. The aspects space security have become broader and more diverse, going beyond preparations for military operations and regulations on space weapons to the risk of cyber attacks or terrorism against space assets that are directly and closely related to the daily lives of citizens.
Recently, Russia and China have opinions that there are many loopholes in the 1967 Outer Space Treaty to respond to the weaponization of outer space, so they have a new legally binding international treaty for the Prevention of Arms Race in Space (PAROS). They are “2008 Draft Treaty on the Prevention of the Placement of Weapons in Outer Space, the Threat or Use of Force against Outer Space Objects” (2008 PPWT) and “2014 Draft Treaty on the Prevention of the Placement of Weapons in Outer Space, the Threat or Use of Force against Outer Space Objects” (2014 PPWT). Regarding PPWT, the United States insists that there is no problem that can be solved through arms control in outer space because an arms race has not yet occurred in outer space.
In fact, the opinion of supporters of hard law that a legally binding treaty should be adopted to regulate the weaponization of outer space is correct, but at the present time when enactment of treaties has become difficult after the 1979 Moon Agreement, it would be a good idea to encourage the participation of countries by developing soft law guidelines as an interim measure to ultimately create an integrated and binding legal instrument for all aspects related to the use of outer space. In that respect, I think the resolution (A/RES/77/41) adopted by the United Nations General Assembly on December 7, 2022 to encourage not performing “destructive direct ascension (DA) ASAT testing” is a good model.
