특별행정심판제도의 남설로 인해 국민의 권리구제 선택에 어려움을 주고 있는 것이 현실이다. 행정심판 통합은 오래전부터 논의되었지만, 오늘날에도 여전히 어려운 문제다. 행정심판 통합 문제를 일괄적으로 처리하는 것은 실현되기가 어렵다. 이러한 문제는 행정조직의 통폐합뿐만 아니라 특별행정심판 재결의 특수성도 관련되어 있기 때문이다. 나아가 행정심판의 통합은 행정소송에도 적지 않은 영향을 미친다. 행정심판 통합을 분야별로 검토하는 것이 중요한 출발점이다. 본고에서는 중앙토지수용위원회와 중앙행정심판위원회의 행정심판 통합을 검토하였다. 행정심판의 전문성과 특수성을 고려할 때 중앙토지수용위원회를 폐지하고 그 기능을 중앙행정심판위원회에 흡수하는 방안은 바람직하지 않다. 그러나 「개발이익환수에 관한 법률」에 따른 개발부담금, 「재건축초과이익 환수에 관한 법률」에 따른 재건축부담금 등의 부과처분에 관한 행정심판 사건은 통상적인 금전급부를 다투는 것이므로 중앙행정심판위원회에서 통합하여 관할하더라도 큰 문제는 없다. 중앙토지수용위원회의 행정심판(특히 이의재결)을 중앙행정심판위원회에 이전할 수 있는지가 중요한 쟁점이다. 중앙토지수용위원회의 수용재결에 불복하는 이의신청에 대해 다시 중앙토지수용위원회가 재결을 내리는 것은 행정의 자기통제와 권리구제라는 행정심판의 제도적 기능에 비추어 적절하지 않다. 이러한 방식은 행정심판의 공정성이나 절차적 정의의 측면에서도 바람직하지 않다. 중앙토지수용위원회의 행정심판(특히 이의재결) 권한을 이전할 경우, 청구기간이나 간접강제 등을 활용할 수 있다는 점에서 사인의 권리구제에 유리한 점도 있다. 그러나 중앙토지수용위원회의 이의재결 권한을 중앙행정심판위원회로 이전하면 행정심판이나 행정소송에 여러 가지 변화가 발생할 수 있다. 이러한 변화가 일반 국민에게 혼선을 초래할 수 있는 측면도 있으므로 행정조직의 무리한 통합보다는 행정심판의 기능적 통합을 단계적으로 실현하는 방안이 합리적이다.
The overuse of the special administrative review system has made it difficult for people to choose their legal remedies. Although the unification of administrative appeals has been discussed for a long time, it is still a problematic issue today. It is difficult to realize the unification of administrative appeals in a single step. This is because it involves the integration of administrative organizations and the specificities of adjudication of special administrative appeals. Moreover, the unification of administrative appeals has a significant impact on administrative litigation. An important starting point is to examine the integration of administrative appeals by sector. This paper examines the integration of administrative appeals by the Central Land Tribunal and the Central Administrative Appeals Commission. Given the professionalism and specificity of administrative appeals, it is not advisable to abolish the Central Land Tribunal and integrate its functions into the Central Administrative Appeals Commission. However, administrative appeals regarding the imposition of development charges under the Development Profit Recovery Act and reconstruction levies under the Reconstruction Excess Profit Recovery Act are generally disputes over monetary payments, so there is no problem with the Central Administrative Appeals Commission consolidating and assuming jurisdiction over them. An important question is whether administrative appeals (especially appeals) of the Central Land Tribunal can be transferred to the Central Administrative Appeals Commission. It is not appropriate for tfhe institutional function of administrative review to be administrative self-regulation and for the Central Land Tribunal to again decide the appeals against the expropriation decision of the Central Land Tribunal. It is also undesirable from the view of fairness and procedural justice in administrative appeals. Transferring the authority of administrative appeals to the Central Land Tribunal has some advantages for the rights of private individuals, such as the ability to utilize the claim period and indirect coercion. However, transferring the authority to adjudicate appeals from the Central Land Tribunal to the Central Administrative Appeals Commission may result in various changes to administrative appeals and administrative litigation. As these changes may confuse the general public, it is reasonable to realize the functional integration of administrative appeals in stages rather than the unfeasible integration of administrative organizations.
