자동차보험의 무보험차상해보험계약에 중복 가입된 사고 피해자인 피보험자에게 중복보험자 중 1인의 대표보험자가 피보험자의 전체 손해액을 보상하였다면 그 대표보험자가 사고 가해자에게 행사할 수 있는 대위범위가 쟁점이 된다. 최근 대법원에서 가해자의 배상책임액에 대하여 피보험자에게 지급된 보험금 중 보험자가 실제 부담금액 비율만큼 대위행사가 가능하다고 판결하였다. 그러나 이와 같은 결론은 다수의 중복보험자가 가해자를 상대로 개별 대위소송을 제기할 수밖에 없어 소송경제적으로 비효율적이고, 가해자 처지에서도 과다한 소송대응 부담이 발생한다. 본고에서는 보험자의 가해자에 대한 대위구상권과 중복보험자에 대한 중복구상권은 서로 구분되는 별도의 권리라는 점, 어떤 권리를 누구에게 먼저 행사할지는 보험자의 자율재량이라는 점, 중복보험자들 간에 대위 또는 중복구상 정산을 통하여 공평을 기할 수 있는 점 등을 고려한다면, 이 사건 대법원 판결과 달리, 가해자의 책임액 범위 내에서 대표보험자의 대위구상 청구를 전액 인용하더라도 보험자 대위법리 또는 중복보험 구상법리에 어긋나지 않는다는 것을 논증하였다. 이러한 해석은 관련 법리에도 반하지 않으며, 1회적 소송을 통한 소송경제의 효율을 기하여 사회적 비용을 최소화시킬 수 있는 방법이기도 하다.
In scenarios where a victim of a car accident is covered by multiple uninsured motorist insurance policies, if one of the double insurers, acting as the representative insurer (hereafter referred to as 'RI'), fully compensates the victim's total loss, the RI possesses indemnity rights under double insurance contracts against the other double insurers. Furthermore, apart from this, the RI also holds subrogation rights under the insurer's subrogation against the wrongdoer of the accident. A recent ruling by the Supreme Court has embraced the reasoning of preceding analogous cases, confirming that the extent of subrogation rights, exercisable by the RI against the wrongdoer, is proportionate to the actual amount each double insurer has borne concerning the insurance payment made to the victim, up to the wrongdoer's liability amount. Nevertheless, disparities exist between this Supreme Court ruling and prior cases, necessitating multiple double insurers to individually initiate subrogation lawsuits against the wrongdoer, which can be deemed inefficient from a litigation economy standpoint. Therefore, exploring alternative solutions may prove beneficial.
The subrogation right held by the RI against the wrongdoer and the indemnity right against other double insurers are distinct and separate rights. Additionally, the decision on which right to exercise and against whom first lies within the insurer's discretion. Furthermore, by settling indemnity rights based on double insurance and resolving subrogation claims among the RI and other double insurers, the same effect as the court ruling can be achieved. Therefore, in contrast to this Supreme Court ruling, it can be contended that invoking the RI's subrogation claim in full within the scope of the wrongdoer's liability amount does not contradict the subrogation principles of insurance or reimbursement among double insurers. This interpretation aligns with relevant legal principles and is more efficient from a litigation economy perspective, minimizing social costs and alleviating the undue burden on the wrongdoer through a single lawsuit.
