헌법은 “국민적 합의에 의해 제정된 국민생활의 최고 도덕규범이며 정치생활의 가치규범”으로서 정치와 사회질서의 지침을 제공하고 있기 때문에 민주시민교육은 시민들에게 이러한 헌법적 약속의 의미를 환기하고 이를 상식적 행위규범으로 삼아 시민생활을 영위하는 시민의 민주적 역량을 함양하는데 초점을 두어야 한다. 바로 이런 의미에서 민주시민교육의 기초는 헌법에 두어야 하고, 이로써 민주시민교육은 헌법의 기본지식에 대한 교육과 더불어 시민으로 하여금 민주시민이 되게 하는 핵심덕성을 공동체 기본규범인 헌법을 통해 도출한 헌법적 시민성(constitutional citizenship)에 대한 교육이어야 한다.
한편 헌법적 시민성은 개인으로서 시민이 공사영역에서의 자율성을 함양하고 정치적 능동성을 권리이자 의무로서 자각하는 것은 물론 공공복리에 입각하여 안전과 위험으로부터의 자유를 향유할 권리인 사회권과 그에 상응하여 공공복리를 위해 사유재산을 비롯하여 개인의 권리 행사를 절제할 의무가 조화로이 구현될 수 있는 헌법실천의 과제가 된다.
나아가 헌법적 시민성은 국가와 사회의 최고규범인 헌법에서 헌법계약의 방식으로 이미 사회적 합의를 이룬 것이므로 헌법에 기초한 민주시민교육은 이러한 사회적 합의를 충실히 이해하고 실천할 수 있는 환경을 조성하는 데 기여해야한다. 시민의 약속인 헌법이 내포한 가치와 그 구현을 위한 기본원리들은 시민생활에서 구체적으로 제기되는 다양하고도 복합적인 현안들을 합리적으로 해결하기 위한 실제적인 기본지침이 되며, 민주시민교육의 내용과 방식에 대한 사회적 합의는 다음과 같은 두 가지 최소한의 인식을 공유하여야 한다. 첫째, 다양성은 전제이지 합의의 대상이 아니다. 둘째, 헌법적 가치질서에 입각하여 참여자의 선택과 필요가 실현되어야 한다.
결론적으로 민주공화국의 최고규범인 헌법에 비추어 본 시민교육의 원론적 필요성을 고려할 때 최근 우리 사회 일각에서 일부 편향적 교육방법과 운용상의 문제를 사회적 합의의 부재의 탓으로 돌리면서 민주시민교육의 축소나 폐지를 주장하는 것은 민주시민교육의 필요성과 헌법적 정당성을 부정하는 것이나 다름없다. 오히려 그 운용상의 문제를 정면에서 해결하기 위해 사회적 합의 그 자체인 헌법에 기초한 민주시민교육이 더욱 활성화되어야 한다. 민주시민교육이야말로 우리 사회가 당면하고 있는 분열적이고 갈등적인 상황을 극복하는 정치사회적 기본토대를 구축하는 올바른 대안임을 유념해야 하는 것이다.
Since the Constitution provides guidelines for political and social order as the "highest moral norm of the people's life and the value norm of political life" enacted by the national consensus, democratic civic education should focus on reminding the meaning of these constitutional promises to citizens and cultivating citizens' democratic capacities to lead civic life by using them as common sense norms of conduct. In this sense, the foundation of democratic civic education should be the Constitution, which means that democratic civic education should not only provide education on the basic knowledge of the Constitution, but also education on constitutional citizenship, which is derived from the Constitution as the basic norm of the community and the core virtues that make each citizen a democratic citizen.
On the other hand, constitutional citizenship becomes a task of constitutional practice in which citizens, as individuals, cultivate autonomy in both private and public spheres and recognize the importance and necessity of political participation as a right and duty at the same time, as well as the social right based on public welfare, which is the right to enjoy safety and freedom from various dangers and risks, and the obligation to exercise individual rights, including private property, in harmony with public welfare.
Furthermore, since constitutional citizenship is already a social agreement in the form of a constitutional contract in the Constitution, which is the highest norm of the state and society, constitutional civic education based on the Constitution should contribute to creating an environment where this social agreement can be faithfully understood and practiced. The values implicit in the Constitution as a civic promise and the basic principles for its implementation serve as practical guidelines for rationally resolving the diverse and complex issues that arise in concrete civic life, and the social consensus on the content and methods of civic education should share two minimum recognitions. First, diversity is a premise, not an object of consensus. Second, the choices and needs of participants must be realized based on the constitutional value order.
In conclusion, considering the primal necessity of democratic civic education in light of the Constitution, the supreme norm of a democratic republic, it would be a denial of the necessity and constitutional legitimacy of democratic civic education to argue for the reduction or abolition of democratic civic education by blaming the lack of social consensus for some biased teaching methods and operational problems in recent years. Rather, democratic civic education based on the Constitution, which is the social consensus itself, should be further revitalized to solve its operational problems head-on. It should be kept in mind that democratic civic education is the right alternative to build a political and social foundation to overcome the divisive and conflictual situation our society is facing.
