이 글은 2020년 12월 4일에 제정하여 시행 중인 북한의 ‘반동사상문화배격법’을 논구한 것이다. 글의 순서는 우선 이 법의 제정 배경과 입법 취지를 살펴보고, 이어 주요한 내용을 분석한다음, 이 법의 특징과 문제점을 검토하였다. 김정은은 2011년 정권을 세습한 이래 선대의 유훈통치뿐만 아니라 사회주의식 법치주의를 시행하고자 다양한 법률들을 제정하였다. 서구식 법의지배가 아닌 법을 이용한 지배를 지향하였다. 이러한 입법 활동은 이중적인 목적이 있었다. 김정은 집권 후 국제사회에 누적된 부정적인 이미지의 개선을 위한 전시용 입법과 북한 주민들의 불만을 통제하기 위한 통제용 입법이었다. ‘반동사상문화배격법’은 대표적인 주민 통제를 위한 입법으로, 서구 사회에서는 상상할 수 없을 정도로 기본권을 제한하고 있다. 북한 주민들, 특히 청년 세대의 사상과 문화 활동을 통제하기 위해 외국으로부터 영화나 드라마, 음악 등 미디어 형태의 문화 전반에 대해 유입과 유포 및 시청을 통제하는 것을 주된 내용으로 한다. 따라서 예전과같이 불온 문서 등 내용을 고려한 것이 아니라 내용 여부를 따지지 않고 외국의 문화 자체를 통제하는 것이다. 또한 북한 주민들의 콘텐츠 개발과 유포 등도 통제하고 있다. 북한 주민들의 정보접근권을 원천적으로 차단하고 있는 것이 가장 큰 문제이다. 북한 정권 자체가 세계로부터 고립을 자초하고 있는 것이다. 이 법을 위반한 경우 중할 때에는 무기로동교화형이나 사형에 처할수 있을 만큼 가혹한 형벌이 부과된다. 또한 알고도 신고하지 않은 자들을 처벌하는 불신고죄와기관이 관리 소홀에 대한 책임뿐만 아니라 유포한 것 자체에 대해서도 책임을 지게 하는 연좌제를도입한 것도 문제이다. 과연 이러한 고립정책이 얼마나 오래 지속할 수 있을지 회의적이다. 남한뿐만 아니라 유엔 등은 북한 주민의 정보접근권을 비롯한 전방위적인 기본권의 제한을 개선할 수있는 방안을 모색해야 할 시점이다. 단순히 비판이나 관심을 넘어 유엔 등 각종 기관이나 단체가상호 협조 아래 실질적으로 북한 주민의 인권 상황이 개선될 수 있도록 노력해야 할 것이다.
This article discusses the North Korean ‘Reactionary ideology and culture rejection act’, which was enacted and in effect on December 4, 2020. The order of the article was to first examine the background of the enactment and legislative purpose of this act, then analyze the main contents, and then review the characteristics and problems of this act.
Since Kim Jong-un inherited the regime in 2011, he has enacted various acts to enforce the socialist rule of law as well as the rule of honor. It was aimed at domination using law, not the rule of Western-style law. These legislative activities had a dual purpose. It was a wartime legislation to improve the negative image accumulated in the international community after Kim Jong-un took power, and a control legislation to control North Korean residents' complaints. The ‘Reactionary ideology and culture rejection act’ is a representative legislation for controlling residents and includes restrictions on basic liberal rights beyond imagination in Western society. The main content is to control the influx, dissemination, and viewing of media types such as movies, dramas, and music from abroad in order to control the thoughts and cultural activities of North Koreans, especially the younger generation. Therefore, it does not consider the contents such as disturbing documents as in the past, but controls the foreign culture itself regardless of whether the contents are included or not. It also controls the development and distribution of content by North Koreans. The biggest problem is that North Koreans' right to access information is fundamentally blocked. The North Korean regime itself has caused isolation from the world.
Violations of this act are subject to severe penalties that can lead to life and death. It is also a problem that has introduced a system of non-reporting crimes that punish those who do not report knowingly and holding the institution accountable for what it has distributed, as well as negligence of management. It is skeptical how long this isolation policy can last. It is time for South Korea as well as the United Nations to seek ways to improve the restrictions on all-round basic rights, including the right to access information of North Koreans. Beyond simple criticism and interest, various institutions and organizations, such as the United Nations, should make efforts to substantially improve the human rights situation of North Koreans through mutual cooperation.
