대한민국의 초저출산 문제는 학령인구와 맞물려 대학에도 영향을 미치고 있다. 이러한 시대적 변화에 따라 대학도 변화가 필요하다. 기존의 기술적인 역량 및 학문에 대한 전문지식뿐만 아니라 인권 친화적인 경험은 대학교육에서 결코 간과할 수 없는 영역이 되었다. 「헌법」에서 대학의 자치를 보호하는 이유는 대학의 기능을 충분히 발휘하도록 하는 것이며, 대학의 기능은 대학인이 연구 및 교육을 자유롭게 하여 진리탐구와 지도적 인격의 도야를 할 수 있도록 돕는 데 있다. 그뿐만 아니라 「고등교육법」에 인권센터 관련 내용이 제정됨에 따라 대학은 학생의 인권을 보장해야 할 의무가 강화되었다. 대학에서 대학(원)생의 인권보장 강화를 위한 인권센터 이행 방안 및 법제 개선 방안은 다음과 같다. 첫째, 인권센터 독립성 확보를 위해 인권침해 사안에서 갑질 및 직장 내 괴롭힘의 영역은 분리되어야 한다. 둘째, 인권센터 업무수행의 접근방식 차이의 명확화를 위해서 상담 방법과 신고조사 방법의 차이와 인권침해 영역과 성희롱・성폭력 영역에서 기준의 차이가 있음을 인지해야 한다. 이런 차이를 극복하려면 장기적인 관점으로 인권 및 성희롱・성폭력 예방과 관련한 정부 기관의 일원화가 필요하다. 셋째, 폭력예방교육의 범위 확대 및 전문 인력 확충이 필요하다. 기존에 성희롱・성폭력과 관련된 폭력예방교육의 인권감수성을 높이는 인권교육이 포함되도록 범위를 확대함과 동시에 확장된 폭력예방교육을 진행할 수 있는 전문 인력도 확충되어야 한다. 넷째, 사후 관리 및 규정 개정을 통한 대학 인권센터 역량 강화가 이루어져야 한다. 인권센터 결정의 강제성 부족의 한계를 극복하기 위해 사건 당사자에 대한 꾸준한 사후 관리를 통해 대학 구성원들의 신뢰를 얻고, 인권센터 규정에 실질적 구속력을 확보할 수 있는 내용을 포함해야 한다.
South Korea's super-low birthrate is closely linked to its school-age population, and it's affecting universities. In accordance with these changing times, universities also need to change. In addition to traditional technical skills and academic expertise, human rights-friendly experiences at universities have become an integral part of university education that cannot be taken lightly (or overlooked).
The reason the Constitution protects the autonomy of universities is to ensure that they can fully fulfill their functions. The function of universities is to help university students freely pursue research and education so that they can pursue the search for truth and develop leadership character. In addition, universities are obligated to protect the human rights of students. Since the Higher Education Act has enacted provisions related to human rights centers, the following are the implementation plans for human rights centers and legal improvements to strengthen the human rights of university students.
First, in order to secure the independence of the Human Rights Center, the areas of a power trip and workplace harassment must be separated from human rights violation cases.
Second, differences in approaches depending on the human rights center's work area must be clearly recognized. It is important to note that there are differences in counseling methods and reporting investigation methods, as well as differences in standards in the areas of human rights violations and sexual harassment and violence. To overcome these differences, one government agency must take full responsibility for human rights and the prevention of sexual harassment and violence from a long-term perspective.
Third, it is necessary to expand the scope of violence prevention education and increase the number of specialized personnel. The scope of existing violence prevention education related to sexual harassment and sexual violence should be expanded to include human rights education that increases human rights sensitivity. In addition, it is necessary to stabilize the number of specialized personnel who can conduct expanded violence prevention education.
Fourth, the capacity of university human rights centers should be strengthened through follow-up and revision of regulations. Human rights centers are limited by the lack of enforceability of their decisions. To overcome this, it is necessary to gain the trust of university members through continuous follow-up with the parties to the case, and to include provisions in the Human Rights Center's regulations to ensure that they are actually binding.
