소송상 문제로는 주인이 특유재산소송에서 유책판결 받은 경우에는 이 판결채무는 후속 특유재산소송에서 공제되나(Ulp. 29 ad ed. D. 15, 1, 9, 8), 반대로 선행 특유재산소송이 아직 계속 중이고 후행 특유재산소송 판결이 나오는 경우, 선행소송이 후행소송의 유책판결에 있어서 결코 고려되어서는 안 된다고 한다(Gai. 9 ad ed. provinc. D. 15, 1, 10). 이미 특유재산소송의 피고로서 노예에 대한 채권을 공제한 자가 다른 채권자에 의해 특유재산소송을 당한 경우 다시 같은 채권을 공제할 수 있는지에 관해, 네라티우스, 네르바, 율리아누스는 주인이 이것을 특유재산에서 가져간 경우에는 다시 공제해서는 안 되나, 특유재산을 원상태로 둔 경우에는, 공제해야 한다는 입장이었다(Ulp. 29 ad ed. D. 15, 1, 11, 3). 이 견해에 따르면 특유재산 가액 산정 문제에 있어서 솔가권자가 노예나 가자에 대한 채권을 다른 채권자들에 앞서 추급하는 것으로 정당화된 공제권은 솔가권자가 실제 채권의 만족을 받기까지는 지속적으로 작동하는 권리인 셈이다. 특유재산소권의 채권자들은 유책판결을 얻어낸 순서대로 우선권을 가졌다. 그런데 강제집행상 특권이 인정된 혼인지참재산소권과 후견소권과 같은 경우에는 다른 채권자의 소권보다 집행상 우선권이 인정되었다(Paul. 4 quaest. D. 15, 1, 52, 1; Ulp. 33 ad ed. D. 24, 3, 22, 13). 한번 특유재산소권으로 소구하였으나 특유재산의 부족으로 잔여채무를 갖는 자는 향후 특유재산이 증가된 경우 채무 잔액에 관해 소구할 수 있다(Ulp. 29 ad ed. D. 15, 1, 30, 4; Ulp. 2 disp. D. 15, 1, 32pr.; Paul. 4 ad Plaut. D. 15, 1, 47, 3). 그리고 특유재산소송에서 원고의 채권액보다 특유재산 가액이 적은 경우, 특유재산이 장래 증가하는 경우 추가로 변제할 것이라는 담보제공을 원고가 요구할 수 없다는 것이 통설이었다(Paul. 4 ad Plaut. D. 15, 1, 47, 2). 특유재산소송으로 인해 노예의 주인에 대한 채무가 소진되지는 않는다. 특유재산소송의 계속 후에도 노예의 자연채무는 그대로 남아 있으므로, 이를 소멸시키는 변제나 이를 담보하기 위한 보증도 가능하다(Pap. 9 quaest. D. 15, 1, 50, 2). 정노예 명목으로 주인을 상대로 특유재산소권을 행사한 채권자는 부속노예 명목으로는 특유재산소권을 행사할 수 없으나, 반대의 경우에는 가능하였다(Ulp. 29 ad ed. h.t. 19pr.).
In terms of lawsuit issues, if the owner received a judgment of defeat in a actio de peculio, this judgment obligation could be deducted in subsequent lawsuits extant to peculium. On the contrary, if the secondary lawsuit was still ongoing, and the judgment of the secondary lawsuit came out, the primary lawsuit should never be considered in the judgment of the secondary lawsuit. Regarding whether the person who had already deducted the claim against the slave as the defendant in the lawsuit could deduct the same claim again if sued by another creditor in a subsequent lawsuit, Neratius, Nerva, and Ulpian held the position that if the owner took it away from the peculium, it should not be deducted again, but if the peculium was restored to its original state, it should be deducted. According to this view, the right to deduct the claim against the slave or the son in determining the valuation of peculium was justified as the continuous right until the actual satisfaction of the claim. The plaintiffs of the actions extant to the peculium had priority according to the order in which they obtained the judgment of condemnation. In cases where the action for the recovery of the dowry and the action of guardianship, to which the privilege was granted at the compulsory execution, they were given priority over other creditors' claims in execution. If someone had sued by the actio de peculio but had remaining obligations due to the lack of peculium, he could pursue the obligation balance if the peculium increased in the future. And if the valuation of peculium was less than the plaintiff's obligation amount, the plaintiff could not demand additional assurance to cover the remaining debt when the peculium increased in the future. The obligation of the slave to his master was not extinguished by the exercise of the actio de peculio. Even after pendency of the lawsuit extant to the peculium, the natural obligation of the slave remained, so it was possible to extinguish it by paying or provide a guarantee to secure it. After exercising the actio de peculio against the owner for the obligation of a slave, the actio de peculio for the obligation of the sub-slave was not to exercise, but the opposite was possible.
