모든 국민은 정당한 재판을 받을 권리가 있으므로 항소심 판결에 불복이 있는 당사자는 상고를 제기할 수 있다. 상고인이 상고장에 상고이유를 기재하지 않은 때에는 소송기록접수통지를 받은 날부터 20일 이내에 상고이유서를 제출하여야 한다. 상고인이 이를 어기어 상고이유서를 위 기간 내에 제출하지 않은 때에는 상고법원은 직권조사사항이 있는 경우를 제외하고 변론 없이 판결로 상고를 기각한다. 그런데 당사자가 책임 없는 사유로 민사소송법이 정한 상고이유서 제출기간을 도과한 경우 어떻게 구제받을 수 있는지 문제가 된다.
소송절차에서 당사자는 각종 소송행위를 함에 있어 일정한 기간의 제약을 받는다. 민사소송법에서 미리 기간의 길이가 정해져 있는 기간을 법정기간이라고 하고, 법정기간은 다시 불변기간과 통상기간으로 나눌 수 있다. 불변기간에 대해서는 기간의 신축을 허용하지 않는 대신 부가기간을 설정하거나 당사자에게 귀책사유가 없는 경우 소송행위의 추후보완이 가능하다. 한편 통상기간에 대해서는 법원이 재량에 따라 그 기간을 늘이거나 줄이는 것이 가능하다.
민사소송법은 상고이유서 제출기간을 불변기간으로 정하고 있지 않으므로 통상기간이라고 보아야 한다. 따라서 당사자의 책임 없는 사유로 상고이유서 제출기간을 도과한 경우 민사소송법 제172조 제1항 규정에 따라 당사자는 그 사유를 소명하여 상고이유서 제출기간 연장을 신청하고 상고법원은 그 신청에 대한 연장 허부 결정을 통하여 해당 당사자의 상고이유서 제출을 허용하는 것이 바람직하다. 그리고 이는 소송행위의 추후보완이 아니므로 그 사유를 당사자가 책임질 수 없는 사유로 엄격하게 한정할 것도 아니다.
대법원은 상고인이 상고이유서 제출기간을 어기었을 때 기계적으로 상고이유서 부제출을 이유로 상고를 기각하고 있는 것으로 보인다. 하지만 이러한 형태의 상고심 운영은 책임 없는 사유로 상고이유서 제출기간을 지키지 못한 상고인의 절차 보장, 사법제도에 의한 권리구제의 충분성 등의 측면에서 적절하다고 볼 수 없다. 정해진 기간 내에 상고이유서를 제출하지 못한 채 상고기각 판결을 받는 상고인이 적지 않은 상황에서 대법원이 상고이유서 제출기간의 본연의 법적 성질에 따라 그 기간의 신장에 대하여 전향적인 태도를 보이는 것이 바람직하다.
Since all citizens have the right to a fair trial, a party dissatisfied with the judgment of the appeal trial may file an appeal. When the grounds for appeal to the Supreme Court have not been entered in a petition for the final appeal, the appellant shall submit a written statement of grounds for the final appeal within 20 days from the date of receiving the notice. If the appellant has failed to submit a written statement of grounds for appeal to the Supreme Court, the court of final appeal shall reject the final appeal by its judgment without holding any pleadings, except in cases when there exist any grounds to be investigated ex officio. However, there is question on how an appellant can receive relief if he or she exceeds the submission period for reasons that he or she is not responsible for.
In litigation proceedings, the parties are restricted for a certain period of time in engaging in various litigation activities. In the Civil Procedure Act, the period in which the length is predetermined is called the statutory period, and the statutory period can be divided into the invariable period and the ordinary period. For the invariable period, the period is fixed and an additional period can be set, or if there is no reason attributable to the parties, he or she may subsequently complete the litigation. On the other hand, for the ordinary period, it is possible for the court to extend or shorten the period at its discretion.
The Civil Procedure Act does not stipulate the period for submission of written statement of ground for appeal to the Supreme Court as an unchangeable period, so it should be regarded as an ordinary period. If the period for submission of written statement of ground for appeal to the Supreme Court is exceeded due to reasons not responsible to the parties, it is desirable that the parties clarify the reason and apply for an extension of the period pursuant to Article 172 (1) of the Civil Procedure Act, and the Supreme Court allow the parties to submit the reason for appeal through a decision to grant an extension of the period. Since this is not a subsequent completion of litigation, it is not strictly limited to reasons that the parties cannot be responsible for.
The Supreme Court appears to be mechanically dismissing the appeal under Article 429(Rejection of Appeal to the Supreme Court Due to Lack of Submission of Written Statement of Grounds for Appeal to the Supreme Court), when the appellant violates the period for submission of written statement of ground for appeal to the Supreme Court. This type of appeal operation can be said to be negligent in terms of ensuring the procedure of the appellant who fails to comply with the period due to irresponsible reasons, and the sufficiency of remedy for rights by the judicial system. It is desirable for the Supreme Court to take a forward-looking attitude toward the extension of the period according to the natural legal nature of the period for submission of written statement of ground for appeal to the Supreme Court, given that not a few appellants have failed to submit a reason for appeal within the fixed period.
