공직선거법 제59조는 선거운동은 선거운동기간에만 가능하되, 온라인매체와 말(言)로 하는 선거운동은 기간 제한 없이 할 수 있음을 규정하고 있다. 그런데 온라인매체와 말로 하는 선거운동을 이처럼 상시 허용하는 개정이 이루어진 경과를 보면 순서상 정반대인데, 전자는 헌재결정 후 국회의 법률 개정이, 후자는 국회의 법률 개정 후 헌재 결정이 있었다. 전자의 개정은 2012년에, 후자의 개정은 2020년에 이루어져 양자는 본질적인 차이가 없음에도 상시 허용 여부의 차이가 8년 이상 지속된 특성도 있다. 이러한 헌재 결정 및 국회의 법률 개정과 관련하여 중앙선관위의 개정의견과 운용기준도 중요한 역할을 하였다. 이처럼 온라인매체와 말로 하는 선거운동을 상시 허용하는 개정을 함에 있어 여러 특수성이 있어, 본 연구에서 그 개정 경과의 특징과 시사점을 분석하였다.
Article 59 of the Public Official Election Act stipulates that election campaigns are only possible during certain periods, but election campaigns using online media and verbal can be conducted without the limit. There were two revisions that allow online media and verbal campaigns at all times; the former was revised by the National Assembly after the Constitutional Court's decision, and the latter is in the opposite order. The former revision was made in 2012 and the latter in 2020.
Despite having essentially the same characteristics between the two, the difference in whether or not to allow it at all times has lasted for more than 8 years. Regarding these revisions, the opinions and operating standards of the Central Election Commission played an important role. This study analyzed the characteristics and implications of these revisions.
