인신사고의 가해자는 피해자에게 그로 인한 손해를 전보해 주어야 한다. 그러나 인신사고로 인한 손해 중 일실수입액은 그 특성상 증명이 불가능하고 오로지 추론만이 가능한데, 추론 과정에 반영해야 하는 사정과 법칙이 무엇인지는 정해진 바가 없다. 그럼에도 현가산정에 관한 이른바 중간이자공제는 우리 실무와 학계에서 인신사고로 인한 손해배상의 일반적인 원칙으로 받아들여진다.
우리 실무는 사고 시를 중간이자공제의 기준시점으로 삼으면서, 그 이율에 법정이율을 적용한다. 그러면서도 사실심 변론종결 시까지의 인상된 수입은 반영하지만, 사실심 변론종결 이후의 장래수입변동은 반영하지 않는 것이 일반적이다. 이처럼 중간이자는 공제하면서 그 이면인 장래수입변동을 반영하지 않는 방식은 모순이고, 이런 방식은 소송이 지연될수록 손해배상액수가 늘어나고 항소를 초래한다는 점에서도 부당하다.
따라서 장래수입변동률은 마땅히 현가산정 과정에서 반영되어야 한다. 구체적인 장래수입변동률은 사실인정을 통하여 확정하는 것이 논리적이나, 장래수입변동의 이면인 중간이자를 공제함에 있어 법정이율을 적용하는 조치는 현실적인 측면에서 볼 때 부당하다고 할 수 없는데, 이 경우에는 장래수입변동률, 예컨대 노동가치변화율의 기준도 법정이율로 봄이 마땅하고, 실증적으로도 중간이자에 관한 여러 요인과 장래수입변동에 관한 여러 요인은 동등하다고 평가할 수 있는 점을 고려하면, 장래수입변동률 역시 법정이율로 봄이 마땅하다.
그렇다면 중간이자공제는 더는 필요하지 않다. 가장 정당한 현가산정방법은 단순히 소득액에 가동기간을 곱하는, 전체상쇄방법 중 구 알래스카주 방식이다.
The perpetrator of a personal injury must compensate the victim for the damages caused. However, in the case of damages arising from a personal injury, the loss of future earnings is inherently unprovable and can only be inferred, and there are no established rules or laws regarding the factors that should be considered in the process of inference. Nevertheless, the so-called “future interest deduction”, used in calculating the present value of the loss of future earnings, is generally accepted as a guiding principle of compensation for damages resulting from personal injury in both our practical and academic fields.
Our practice establishes the time of the accident as the reference point for the future interest deduction and applies the statutory interest rate to the interest rate. Furthermore, it takes into account the earnings increased by not later than the time the pleadings closes in fact-finding proceedings, while it does not generally consider changes in the future earnings after the closure of pleadings in fact-finding proceedings. As such, this method, deducting future interest during the calculation of present value while neglecting changes in the future earnings associated with future interest, is inherently contradictory and unfair in that as the litigation is prolonged, damages increase, which leads to an appeal.
Therefore, the rate of change in the future earnings should be appropriately taken into account in the process of calculating the present value. Determining the specific rate of change in the future earnings through court proceeding is logical, but the application of the statutory interest rate in deducting future interest cannot be deemed unjust from a practical perspective. Considering that, in that case, viewing the rate of change in the future earnings as the statutory interest rate is reasonable, and, empirically, various factors related to future interest can be evaluated as equivalent to those related to changes in the future earnings, the rate of change in the future earnings should also be regarded as the statutory interest rate.
Accordingly, future interest deduction is no longer necessary. The most fair method of calculating the present value of future damages is the total offset method that was used in the past in the state of Alaska, which simply multiplies unit earnings by the period.
