소송사기에서 판결의 효력이 피해자에게 미칠 수 없다면 사기죄의 기수는 성립할 수 없다. 소송사기에서는 소제기 시점에 실행의 착수가 있다고 보고 있으므로 위와 같은 이유로 사기죄의 결과발생이 불가능하여 사기죄의 기수가 성립하지 않는다고 판단하였다면 그다음으로 불능미수의 성립에 대한 검토가 필요하다. 그러나 판례는 대부분의 사안에서 불능미수에 대해서 검토조차 하지 않고 있고, 불능범 또는 불능미수범을 언급한 사례에서도 위험성에 대한 검토 없이 결과발생의 불가능에 연이어 위험성이 없다는 결론만을 간단히 설시하고 있을 뿐이다.
불능미수에서의 핵심적인 부분은 위험성 판단이라 할 것인데, 판단의 대상과 주체를 구분하여 논의하는 것이 적절하다. 우선 위험성 판단의 대상은 구체적 위험설에 따라 행위 당시에 행위자가 인식한 사정과 일반인이 인식할 수 있었던 사정을 판단의 기초로 하되, 양자가 일치하지 않을 때에는 일반인이 인식가능한 사정을 기초로 하여야 한다. 판단의 주체는 규범의 수범자인 통상적인 사회일반인을 기준으로 하여야 하고, 전문가를 기준으로 할 것은 아니다. 다만 소송사기에서는 피기망자가 법률전문가인 법원이므로, 위험성을 판단하는 주체인 일반인도 법원이 소송에서 정당한 법리를 적용할 것이라고 신뢰할 수 있고, 그 한도 내에서는 자신이 느끼는 위험성을 상쇄시킨다고 할 것이다. 따라서 사망자를 상대로 한 소송에서 행위자가 상대방의 사망사실을 알고 있는지 여부와 상관 없이 일반인이 사망사실을 알고 있었다면 법원으로서는 상속인으로의 당사자표시정정이 이루어지지 않는 한 피고의 사망을 이유로 소각하판결을 하여야 하므로, 일반인의 입장에서도 원고 승소판결이 내려질 위험성은 없어 불능미수가 성립하지 않는다. 반면 일반인이 사망사실을 알지 못한다면 법률전문가인 법원의 관점에서도 그 판결은 유효할 수 있으므로 위험성이 인정된다. 결론적으로 법원은 소송사기에서 결과발생의 가능성이 없다고 판단하면 곧바로 사기죄의 성립을 부정할 것이 아니라 다음 단계로 위험성이 있는지 검토하여야 하고, 그에 따라 불능미수의 성립 여부에 관하여 판단하여야 한다.
