현행 우리나라 연명의료결정법은 다음과 같은 문제점을 가지고 있다. 먼저, 연명의료중단의 허용 대상을 ‘임종과정에 있는 환자’로만 한정하여 ‘말기환자’와 ‘지속적 식물인간 상태의 환자’의 자기결정권을 제대로 보장하지 못하고 있다. 또한, 일반연명의료를 중단 가능한 연명의료의 범위에서 배제하여 연명의료중단 결정의 실효성도 낮은 편이다. 또한, 연명의료중단 의사의 추정과 연명의료중단 의사 대리의 불명확성, 경제적 이해관계로 인한 연명의료중단의 위험성, 노숙자와 미성년자의 자기결정권 보장 문제 등도 존재한다. 이에 법 제정 당시의 입법목적을 충실히 달성하기 위해 다음과 같은 개선방안을 제시하고자 한다. 먼저, 말기환자와 지속적 식물인간 상태의 환자 역시 연명의료 중단 대상으로 허용해야 한다. 말기환자와 지속적 식물인간 상태의 환자 역시 임종과정에 있는 환자 못지않게 연명의료중단이 필요한 환자들이다. 그리고, 연명의료중단의 실효성을 높이기 위해 일반연명의료의 중단 역시 허용해야 한다. 다만, 연명의료중단 대상을 확대하고 일반연명의료의 중단을 허용하게 되면 환자의 자기결정권 보장 문제가 더욱 중요해질 것이므로 보다 엄격한 절차적 정당성을 확보해야 할 것이다. 이에 의사 또는 의료기관윤리위원회와 함께 환자의 평소 의사를 추정하거나 법원의 사전통제 절차를 거치도록 할 필요가 있다. 그 밖에도 지나치게 복잡한 연명의료중단 결정 과정을 보다 간소화해야 한다. 또한, 이른바, ‘조력 존엄사’제도를 도입할 필요성도 있다. 법제화를 통해 약물 치료나 호스피스 이외에 추가로 의사조력자살이 인정되면 한편으론 환자 개인의 자기결정권과 인간다운 죽음을 맞이할 기본권이 보다 충실히 보장될 것이다. 또한, 연명의료중단을 담당하고 있는 일선 병원의 의사와 간호사 등 의료인에 대한 연명의료중단제도에 대한 교육을 강화하여 전문성도 확보할 필요가 있으며, 그 성격이 확연히 다른 호스피스・완화의료 관련법과 연명의료중단결정에 관한 법의 분리도 필요한바, ‘연명의료중단결정의 과정에 대한 법률’과 ‘호스피스・완화의료의 제도화와 양질의 서비스를 위한 법률’이 따로 마련될 필요가 있다.
The ACT ON HOSPICE AND PALLIATIVE CARE AND DECISIONS ON LIFE- SUSTAINING TREATMENT FOR PATIENTS AT THE END OF LIFE limits the discontinuation of life-sustaining treatment to only patients in the dying process, failing to guarantee the right to self-determination of terminally ill patients and patients in a persistent vegetative state. In addition, general life-sustaining treatment is excluded from the scope of life-sustaining treatment that can be discontinued, thereby reducing the effectiveness of the decision to discontinue life-sustaining treatment. In addition, there are uncertainties in presumption of intention and representation, the risk of discontinuation of life-sustaining treatment due to economic interests, and the issue of guaranteeing minors' right to self-determination. Accordingly, in order to faithfully achieve the purpose at the time of the original enactment of the law, we propose the following alternatives. First, discontinuation of life-sustaining treatment should be allowed for terminally ill patients and patients in a persistent vegetative state. In order to increase the effectiveness of discontinuation of life-sustaining treatment, discontinuation of general life-sustaining treatment should also be permitted. However, if the scope of discontinuation of life-sustaining treatment is expanded and discontinuation of general life-sustaining treatment is permitted, the issue of ensuring the patient's right to self-determination becomes more important, so more stringent procedural justification will need to be secured. Therefore, it is necessary to determine the patient's intention with the doctor or medical institution ethics committee or go through the court's prior control procedures. There is also a need to simplify the currently complex decision-making process for discontinuing life-sustaining treatment. In addition, there is a need to introduce the so-called ‘assisted death with dignity' system. In addition, it is necessary to secure expertise by strengthening education on the life-sustaining treatment discontinuation system and hospice-related laws for medical personnel such as doctors and nurses at frontline hospitals who are in charge of discontinuing life-sustaining treatment. Additionally, it is necessary to separate and supplement the laws regarding decisions to discontinue life-sustaining treatment. In other words, the 'Act on the process of deciding to discontinue life-sustaining treatment' and the 'Act on the institutionalization and quality services of hospice palliative care' need to be separated.
