이 논문은 법의 속성을 제재(법제처, 법령 입안 심사 기준, 2021)라기보다는 합의(合意)로 정의하고, 이 개념을 통해 국제법 및 기타 처벌규정과 제재가 없는 기준을 정하는 법제도를 만들 수 있으며, 이러한 법제가 디지털 사회에 필요하다는 화두를 제시한다.
법의 실효성 확보 수단인 형사처벌, 행정벌, 행정질서벌, 강제집행, 즉시강제, 행정명령, 행정지도, 이행명령, 민사 손해배상, 그리고 코드・아키텍처에 의한 규제 중 임시조치(notice and take down) 같은 다양한 수단을 분야와 대상의 특성을 고려하여 헌법 제37조 제2항에 따라 적정하고 최소한도록 사용하여야 한다. 위반행위에 모두 형사처벌 규정을 두게 되면 법의 취지가 왜곡되고 오히려 실효성 확보가 장시간에 걸친 형사절차의 진행으로 더 어렵게 될 수도 있다는 사실을 데이터보호 관련 법제의 국내외 비교를 통해 설명한다.
디지털 시대에 코드 규제, 아키텍처 규제는 물론 네거티브규제나 사전규제・사후규제의 선택적 고려, 그리고 위반행위에 대해서 처벌 규정을 두지 않고 이로 인해 발생한 손해에 민사구제를 하거나 이것이 적절하지 않은 경우에는 배액배상 조문을 두는 방식으로 최소한의 합리적 규제를 도모해야 하고, 제정법 단계에서는 낮은 단계의 규제를 사용하고 필요한 경우 단계적으로 규제 강도를 높이는 단계적 입법 태도가 정착되어야 한다.
또한 이러한 취지가 입법과정에서 반영되기 위해 국회와 법제처의 입법관련 실무서(법제이론과 실제, 2019) 등의 내용 개편이 필요하다.
In this paper, the nature of law is defined as consensus rather than sanctions, and through this concept, it is possible to establish a legal system that sets standards for the international law without other punishment provisions and sanctions. It raises the topic that such legislation is necessary for a digital society.
Furthermore, temporary measures (notice and take down) are among the means of ensuring the effectiveness of the law, such as criminal punishment, administrative punishment, administrative order punishment, compulsory execution, immediate coercion, administrative order, administrative guidance, implementation order, civil compensation, and regulation by code and architecture. The same various legal means must be used appropriately and to a minimum in accordance with Article 37, Paragraph 2 of the Constitution of ROK, taking into account the characteristics of the field and target. If criminal punishment is provided for all violations, the purpose of the law would be distorted and effectiveness will not be secured. This paper explains through a comparison of domestic and international data protection-related laws that law enforcement may become more difficult as the criminal proceedings proceed over a long period of time.
In the digital age code regulation, architecture regulation, as well as selective consideration of negative regulation or pre-regulation and post-regulation, and civil relief, multiplied compensation for damages can incur without criminal punishment for violations. Minimum reasonable regulation should be promoted by providing provisions, and a phased legislative attitude should be established, using low-level regulations at the enactment stage and gradually increasing the intensity of regulations when necessary. In addition, during the legislative process, it is necessary to reflect the legislative techniques for reasonable minimum regulation in the contecnts of the legislative workbook of the National Assembly and the Ministry of Government Legislation.
