변칙적인 부의 무상 이전에 대해 상증세법상 어떻게 과세할 것인지를 설계하기 위해서는 우선적으로 증여세 완전포괄주의를 검토해야 한다. 현행법상 변칙적인 부의 무상이전이 발생하면, 원칙적으로 증여세 완전포괄주의에 따라 이전된 부에 대해 과세가 이뤄지게 되어있기 때문이다. 하지만 현재 증여세 완전포괄주의에 따른 과세는 제대로 작동하지 않고 있다.
본 연구는 증여세 완전포괄주의가 가지는 입법적 결단과 연혁적 취지는 존중하는 입장에서 포괄주의 과세가 이뤄지지 않고 있는 원인을 분석하고자 하였다. 한편, 증여세 완전포괄주의에 대해서는 여전히 헌법상 명확성의 원칙에 반하고, 재산권을 침해한다는 비판이 존재한다.
증여세 완전포괄주의는 대법원이 개별예시규정의 요건에 부합하지 않는 과세를 제한하고 있어 실제 과세가 본격적으로 진행되지 못하고 있다. 그와 같은 소극적인 태도의 배경은 상증세법상 증여 개념이 모호하고, 방대하여 납세자의 예견가능성을 저해하고 있기 때문이라 평가할 수 있다. 따라서 본래의 증여세 완전포괄주의의 입법적 결단을 존중하면서 적정과세를 실현하기 위해서는 유형별 포괄주의 또는 명확성을 높이는 방향으로 개선을 시도하고, 조세 정책적으로 자본이득세를 도입하여 위헌성 논란을 제거해야 한다. 또한 증여세의 본질에 부합하지 않는 일감 몰아주기 등의 과세시도는 행정규제법령으로 정리하여야 한다.
이러한 문제를 해결하기 위해 본 연구는 현시점에서 증여세 완전포괄주의에 대한 대법원의 과세 인정 동향을 분석하고, 주요국의 과세체계를 우선적으로 검토하였다(∏). 다음으로 증여세 완전포괄주의의 위헌성을 검토하였고(Ⅲ), 그에 따른 문제점 및 개선방안을 제시하였다(Ⅳ).
In designing the gift tax treatment of an anomalous gratuitous transfer of wealth, the first step is to consider the Full Comprehensive Taxation of a Gift Tax. Under current law, when an anomalous free transfer of wealth occurs, the transferred wealth is, in principle, taxed under the Full Comprehensive Taxation of a Gift Tax. However, the current gift tax system is not working well.
This study aims to analyze the reasons for the lack of inclusionary taxation while respecting the legislative decision and historical intent of the Full Comprehensive Taxation of a Gift Tax. On the other hand, there are still criticisms of the Full Comprehensive Taxation of a Gift Tax that it violates the principle of constitutional clarity and infringes on property rights.
The Supreme Court has restricted taxation that does not meet the requirements of the Individualized Exemption Rule, so actual taxation has not been fully implemented. The reason behind such a passive attitude is that the concept of gift in the gift tax law is vague and broad, which hinders taxpayers' foreseeability. Therefore, in order to realize appropriate taxation while respecting the legislative decision of full inclusiveness of the original gift tax, improvements should be made in the direction of type-specific inclusiveness or clarity, and a capital gains tax should be introduced as a tax policy to eliminate the constitutionality controversy. In addition, taxation attempts such as work shifting, which are not in line with the essence of gift tax, should be organized through administrative and regulatory laws.
To address these issues, this study analyzes the current trend of the Supreme Court's taxation recognition of gift tax inclusivity and first reviews the taxation systems of major countries (∏). Next, the unconstitutionality of gift tax inclusionism was examined (Ⅲ), and problems and improvement measures were proposed (Ⅳ).
