2023년 9월에 개정된 ‘교권 보호 4법’은 개정 법률과 조항의 수가 많고, 개별 법률 조항들이 서로 연결되어 있어서 종합적인 이해가 필요하다. 그러나 현장 교원과 예비교사, 학부모 등은 그 내용과 의미를 모르는 경우가 많다. 이에 이 연구에서는 교권 보호 4법의 주요 내용과 의미, 향후의 입법적ㆍ정책적 개선과제 등을 분석 및 제시하였다.

‘교권 보호 4법’의 의미는 다음과 같다. 첫째, 교육공동체의 보호자로 학부모 역할 재정립 주문, 둘째, 악성 민원으로부터 교사 보호 시스템 구축의 법률적 근거 마련, 셋째, 무분별한 아동학대 사안 처리로부터 교권 보호, 넷째, 피해 교원 보호ㆍ회복 및 모든 학생의 학습권 보장 강화이다.

개정된 ‘교권 보호 4법’을 효과적으로 시행하고, 향후 교원의 교육활동 보호를 강화하기 위한 입법적ㆍ정책적 개선과제는 다음과 같다. 첫째, 교권 보호 4법과 ｢교원의 학생생활지도에 관한 고시｣의 효과적인 시행을 위해 예산ㆍ인력ㆍ시설 등을 지원할 필요가 있다. 둘째, ｢초ㆍ중등교육법｣ 제20조의2를 개정하여 ｢교원의 학생생활지도에 관한 고시｣의 법률적 근거를 명확하게 할 필요가 있다. 셋째, ｢교원지위법｣의 전체적인 체계를 정비하고, 조문을 개선할 필요가 있다. 넷째, 교직 수행에 필요한 교육법규를 교직과목의 교직소양에 포함시켜야한다. 이를 통해 교원들이 스스로의 권한과 책임을 제대로 이해하고 자신을 지키며 교육활동 보호에 적절하게 대응하도록 지원해야 한다.

The revised “Four Laws on the Protection of Teachers' Education Rights” in September 2023 require comprehensive understanding due to the extensive changes in laws and provisions, often leaving field teachers, pre-service teachers, and parents unfamiliar with its content and significance. This paper elucidates the meaning of the revised acts, emphasizing the re-establishment of parental roles in the educational community, providing a legal foundation against malicious civil complaints, and enhancing protection for both teachers and students' right to learn.

To effectively implement the revised legislation and fortify the safeguarding of teachers' educational activities, key legislative and policy improvements are proposed. Firstly, the allocation of budget, manpower, and facilities should be supported for the efficient execution of the 'Four Laws on the Protection of Teachers' Rights' and the associated 'Notice on Teachers' Student Life Guidance.' Secondly, teaching qualifications should encompass educational laws and regulations necessary for effective teaching performance. This integration aims to empower teachers with a clear understanding of their authority and responsibilities, enabling them to protect themselves and respond adeptly to challenges in educational activities.
