Article I section 1 of the U.S. Constitution provides that "All legislative Powers herein granted shall be vested in a Congress of the United States." However, this provision has never been taken to mean that Congress holds legislative power exclusively. Some delegation is unavoidable. Inevitably, administrative agencies are recipients of legislative power The problem is that this law-making power is not subject to constitutional controls. To solve this issue, the U.S. Congress established a process of rulemaking for law-making by administrative agencies.

The Administrative Procedure Act requires that rulemaking be participatory and comprehensive, and as the Act is presently interpreted, it also requires that rulemaking be "demonstrably rational." Rulemaking is made participatory by Section 553(c) of the Act, which requires that the agency shall give interested persons an opportunity to participate in the rulemaking through submission of written data, views, or arguments. The participation by interested parties should also assure that rulemaking is comprehensive. The input of "interested persons" requires an agency assessment of range of interests affected by a rule.

The administrative rulemaking has evolved into a more rigorous process since the enact of APA in 1946. When U.S. Congress has changed rulemaking procedure, the change usually has been in the direction of synoptic and public-regarding features. However, the most extensive requirement that agencies try to be synoptic to consider and balance all things has been imposed not by U.S. Congress but by President. The Presidents has imposed a regime of "cost benefit analysis" under which a major agency rule must be supported by an analysis and balance of the societal costs and benefits of the rule, an analysis that is subject to review by the Office of Management and Budget.
