본 연구에서는 CISG을 중심으로, 국제물품매매계약에서 계약해제의 요건과 이에 따른 다양한 효과분석을 통하여, 계약위반이 존재하는 경우 매매당사자들이 계약해제권 행사에 있어 관련규정의 실무적용상 예상되는 문제점 내지 유의사항을 종합적인 차원에서 검토하여 실무적 활용도를 제고하는데 그 목적을 두고자 한다. 이를 위하여 계약해제 요건으로서 매도인과 매수인의 계약위반이 존재하는 경우, 이행기 전에 계약위반이 존재하는 경우, 분할이행계약의 경우 계약위반이 존재하는 경우로 구분하여 그 주요내용을 개괄적으로 살펴보며, 요건성립 시 발생하게 되는 다양한 계약해제의 효과(계약상 의무의 소멸, 원상회복의무, 이익반환의무 그리고 물품보존의무 등)에 관하여 심층적으로 분석?검토하고자 한다.

CISG is one of the most important contracts for international sale of goods laws supported by legal communities worldwide. The purpose of this study is to analyze several requirements and effect of avoidance of contract in contracts for the international sale of goods under the CISG (United Nations Convention on Contracts for the International Sale of Goods). First, in this paper, I examined four requirements of avoidance of contract as follows; ① buyer's avoidance of contract, ② seller's avoidance of contract, ③ anticipatory breach of contract, ④ installment contract. In the case of CISG, the main articles for avoidance of contract are 25, 49, 51, 64, 72 and 79. To sum up these articles, breach of contract committed by one of the parties is a fundamental issue if it results in such detriment to the other party as to substantially deprive him of what he is entitled to expect under the contract, unless the party in breach did not foresee and a reasonable person of the same kind in the same circumstances would not have foreseen such a result. Also, I examined effect of avoidance of contract and preservation of goods.
