위원회 중심주의를 채택하고 있는 국회 입법과정으로 인해서 위원회의 기능과 역할은 매우 중요하다. 위원회는 법안을 독자적으로 제안할 수 있는 권한(proposal power)과, 법안을 본회의에 부의하지 않을 수 있는 권한(gatekeeping power)을 갖고 있다. 이와 같은 입법절차상의 제도적 권한은 위원회 입법권력의 핵심을 차지한다.

이 연구는 제18대 국회에 제출된 총 13,913건의 법안의 처리과정에 대한 분석을 통해서 위원회의 입법권력을 입증하였다. 위원회가 제안한 법안은 99.5%가 가결되었으며, 국회를 통과하지 못한 법안은 위원회를 통과하지 못한 법안이었다. 즉 전체 법안 중에서 17.4%만이 위원회에서 가결되었으며, 위원회를 통과한 법안의 97.4%는 본회의를 통과한 것이다.

그리고 위원회에서 가결되는 법안을 여야정당별로 비교분석한 결과 여당안의 생존율이 야당안의 생존율의 2배 정도에 이른 것으로 나타났다. 이는 입법권력이 결국은 다수당이 행사하는 입법권력임을 보여주는 것이다.

In legislative process, committee plays very important role. Committees are the center of policy-making, oversight of government. The committee has the power to propose the bill(positive power), and it has the power not to report the bill to the floor(negative power). This gate-keeping power gives committees disproportionate influence on legislative outcomes.

The purpose of this study is to prove legislative power of committees by analyzing the bill processing in 18th National Assembly. The passage rate of committee bills is 99.5%. Most of the bills failed in 18th National Assembly is died in committees. Only 17.4% of the total bills survived committees, but 97.4% of committee-survived bills survive to the last.

Survival rate of the ruling party is much higher than that of opposition parties. This means legislative power of the committee is exercised by the majority party.
