대한민국의 항공 순위는 국제여객운송 세계 12위, 화물 운송 세계 4위로 종합 세계 6위를 차지하고 있는 만큼 나날이 항공산업이 발전하고 있으며 기존 대형항공사 2곳에 이어 6곳의 저가 항공사까지 객실승무원의 숫자만 1만 3천 4백여 명에 달한다. 현재 객실승무원의 피로관리는 항공안전법 제 56조 비행시간, 비행근무시간에 따른 휴식시간 규정에 따라 관리되고 있으며 이 규정은 ICAO국제 기준 및 해외 선진국들의 근무시간 등에 관한 규정과 비교하였을 때 피로관리로 운용되기에는 상당히 부족해 보인다. 최근 에어부산 객실 승무원이 과도한 피로로 인하여 기내에서 연달아 쓰러지는 사건이 발생하면서 국토교통부에서는 모든 항공사를 상대로 관련법 규정위반 여부를 조사했으나 이를 위반한 항공사는 단 한 곳도 없었다. 이것은 객실승무원의 피로관리가 잘 되고 있다는 의미가 아니다. 현행 항공안전법에서 근무시간에 관한 규정이 존재하지 않을 뿐 아니라 최대 승무(비행)시간이 다른 어떠한 국가들보다도 상향하기 때문이다. 최근 근로기준법 개정에 따라 최대 연장근로 제한 시간이 주 64시간에서 52시간으로 바뀌고 근로시간 및 휴게시간 기준의 적용에 예외 되는 특례 조항의 업종이 16종에서 5종으로 줄면서 많은 부문에서 근로환경이 개선되고 있음을 알 수 있다. 근로기준법의 근로시간 및 휴게시간에 관하여 적용을 받지 못하는 항공운송업은 항공안전법에 그 기준을 두고 있다. 그러나 항공업계의 근 20년 동안 비약적인 발전에도 불구하고 현행 항공안전법의 관련 조항은 현실적인 근로환경을 전혀 반영하지 못하고 있다. 그리하여 본 논문에서는 ICAO의 국제기준 및 권고사항, 해외 다른 국가들의 입법사례, 운항승무원과 객실승무원의 동일한 규정이 적용되는 미국, 유럽과는 달리 현재 다르게 적용되는 객실 승무원과 운항 승무원의 관련 규정과의 차이점을 분석함으로써 현행 항공안전법의 개선방향에 대하여 제시하고자 한다.

The Republic of Korea ranks 6th place(2016) in the world airline and 12th in passenger transport and 4th in cargo transportation and air service market in Korea is getting expended. In consequence, the number of cabin crew has reached over 13,400 of two existing full-service carriers and six low-cost carriers(LCC) on March in 2018.

The fatigue management of cabin crews in Korea is being controlled in accordance with Article 56 of the Aviation Safety Act regulating flight time limitation and the rest time for flight duty period. The standards stipulated in Article 56, however, doesn’t follow sufficiently international trends, including those referred to in an ICAO document and in domestic legislation in several foreign countries.

While there was no any violation of the Aviation Safety Act, the cabin crews of Air Busan fainted away during flight due to excessive fatigue. This case shows well how the current law on fatigue management for cabin crew in Korean airliners is inefficient and unrealistic to keep the cabin crews away from excessive fatigue and to enhance the aviation safety. In particular, there is no any rule on-duty period under the current Aviation Safety Law and the stipulated maximum flight time in the Act is longer than in the laws of the U.S., the U.K., and Singapore.

Although the Labor Standards Act of the Republic of Korea has been revised and introduced a shorter maximum working hours in a week than before, from 64 hours in a week to 52 hours for a week, this does not apply to cabin crews due to Article 59 of the revised Labor Standards Act excluding cabin crews from applying the revised maximum working hours for a week. Therefore, it is the Aviation Safety Act that regulates labor conditions of cabin crews, but this Act does not reflect a realistic working environment at all, differently with the Labor Standards Act did, in spite of the rapid progress of the field of the aviation industry for nearly two decades.

Minding such a current problem of law and policy regulating the fatigue management for cabin crews, the author suggested the desirable proposals for improving the present Aviation Safety Law by analyzing the differences between the relevant regulations of a cabin crew and a flight crew that are applied differently unlike the U.S., Europe countries that apply the same regulations to a flight and a cabin crew. Furthermore, to reach the conclusion, the author regarded internationally recommended standards, in particular, the ICAO’s relevant guidelines and the state practices on this issue.
