최근 한국 사회에서 이민자의 사회보장 또는 사회서비스에의 접근에 관한 우려가 상당한 사회적 논쟁으로 이어지는 시점에서 본 연구는 영국의 이민자 사회권이 어떻게 변화하였는지를 분석하고자 하였다. 특히, 영국 복지제도와 이민제도의 변화 속에서 비EEA 이민자, EEA 이민자, 난민 등 세 가지 이민자 집단의 사회권이 어떻게 변화하였는지를 분석하였다. 전반적으로, 영국 사회에서 이민자 사회권은 이민자의 체류자격에 따라 정도의 차이는 있지만, 비EEA 이민자, EEA 이민자, 난민 등 세 이민자 집단 모두에서 지속적으로 축소되는 모습을 보인다. 1990년대 이후 영국의 복지제도에서 복지수급자의 의무(특히, 노동시장에의 참여)를 강조하는 복지 조건부 경향이 강화됨과 동시에, 이민제도에서 이민자의 의무(특히, 시민적 자격요건)를 요구하는 시민적 통합 접근이 강조됨에 따라, 이민자의 체류자격에 수반된 권리(특히, 복지수급권)는 축소되는 한편, 복지수급과 관련한 이민자의 의무 또는 자격요건이 강화되는 것으로 나타났다. 이상의 분석 결과는 이민자 사회권 개념이 가지는 복잡성뿐 아니라, 이민자 사회권의 변화 이면에 복지수급자의 조건부 또는 의무를 강조하는 정책적 변화가 있음을 보여주었다는 점에서 한국의 이민자 통합에 관한 의미 있는 시사점을 제공한다.

The aim of this study is to examine how immigrants’ social rights have changed in the UK. In particular, as societal concerns over immigrants’ access to the Korean social security system have grown recently, this study is expected to provide academic and policy implications for the integration of immigrants in Korea. It analysed the social rights of three immigrant groups in the UK – i.e., non-EEA immigrants, EEA immigrants and refugees – within welfare and immigration policy changes in the UK. In general, the social rights of three immigrant groups all have contracted over time, although to varying extents. Specifically, since the 1990s the UK welfare system has strengthened welfare conditionality to emphasise welfare recipients’ obligations (e.g., labour market participation), and its immigration system introduced the civic integration approach in relation to citizens’ obligations for integration into the society. With such welfare and immigration policy changes, whereas immigrants’ rights (especially, social rights) accompanied by their status of residence have contracted, their obligations (and eligibility requirements) have increased. The results of this study provide meaningful implications for the integration of immigrants in Korean society, by showing the conceptual complexity of immigrants’ social rights, as well as the influence of welfare and immigration policy changes (particularly, to emphasize the conditionality or obligations of citizens) over their changes.
