인공지능(AI) 기술의 급속한 발전과 정보화 사회로의 전환이 가속화됨에 따라, 사이버 범죄의 양상은 AI를 이용한 데이터 오염에서부터 딥페이크에 이르기까지 다양하고 정교하게 발전하고 있다. AI는 의료, 금융, 제조업, 교육 등 여러 분야에서 혁신을 이끌며 인간의 삶을 편리하고 풍요롭게 만들고 있으나, 이러한 기술 발전은 긍정적인 영향만을 미치는 것은 아니다. AI의 급속한 발전은 사회, 경제, 국가 안보에 이르기까지 광범위한 영향을 미치며, 특히 사이버 범죄와 같은 새로운 위협을 부각시키고 있다.

현재 우리나라의 사이버 시큐리티 법체계는 공공, 민간영역, 주요 기반시설에 대한 규정으로 나누어져 있다. 현재 국회에 발의된 사이버안보법은 없으나, AI 관련 법안 6개가 계류 중이다. 그러나 이 법안들은 AI 기술로 인해 발생할 수 있는 안보 또는 보안에 대한 명확한 규정이 부족하다. 단지, AI 기술로 인한 인간의 신체, 생명에 관한 안전과 신뢰성 확보에 관한 내용이 포함되어 있을 뿐이다. AI 기술의 급속한 발전과 함께 증가하는 사이버 위협에 대응하기에는 현재의 법적 프레임워크가 충분하지 않다.

따라서 통합적 법체계 마련과 법적 규제의 강화, 국제적 협력을 통해 효과적인 대응 전략을 마련해야 한다. 미국의 사례와 같이 AI 기술의 발전에 따른 새로운 사이버 위협을 지속적으로 연구하고, 이에 대한 교육과 훈련을 강화해야 한다. 이를 통해 관련 기관과 인력의 역량을 향상시키고, 신속하고 효과적으로 대응할 수 있는 기반을 마련해야 한다. 마지막으로 사이버안보는 공공과 민간의 협력이 필수적이다. 민간 부문과의 협력을 통해 정보 공유와 공동 대응 체계를 구축함으로써, 전체적인 사이버안보 수준을 높일 수 있을 것이다.

The rapid advancement of Artificial Intelligence (AI) technology and the acceleration of the transition to an information society have led to the diversification and sophistication of cybercrimes, ranging from data poisoning using AI to deepfake technology. While AI drives innovation in various fields such as healthcare, finance, manufacturing, and education, making human life more convenient and enriched, its impact is not solely positive. The rapid development of AI has wide-ranging implications for society, the economy, and national security, particularly highlighting the emergence of new threats like cybercrimes.

Currently, South Korea's cybersecurity legal framework is divided into regulations for the public, private sectors, and critical infrastructure. Although no cybersecurity laws have been proposed in the National Assembly, six AI-related bills are pending. However, these bills lack clear provisions on security or protection from threats that may arise due to AI technology. They mainly focus on ensuring the safety and reliability concerning human health and life. The existing legal framework is insufficient to address the increasing cyber threats accompanying the rapid advancement of AI technology.

Therefore, it is essential to establish an integrated legal system, strengthen legal regulations, and develop effective response strategies through international cooperation. Learning from the United States, continuous research on new cyber threats arising from AI technological advancements, along with enhanced education and training, is crucial. This approach will improve the capabilities of relevant institutions and personnel, providing a foundation for swift and effective responses. Lastly, cybersecurity necessitates public-private collaboration. By building information-sharing and joint response systems in partnership with the private sector, the overall level of cybersecurity can be elevated.
