본 연구의 목적은 종교계 사립학교가 지닌 공공성, 자주성, 정체성이 대립적 관계에서 화해와 통합의 방향으로 나아가기 위한 이론적, 실천적 제안을 하려는 것이다. 본 논문에서는 정부의 개정 사립학교법은 학교법인의 교원임용권과 부모의 학교선택권을 심각하게 침해하는 위헌적 요소가 있음이 밝혔으며, 종교계 사립학교의 공공성, 자주성, 정체성에 대한 정부와 사학의 심각한 인식의 차이가 이러한 갈등 상황을 발생시켰다고 보았다. 또 본 연구는 이러한 갈등 상황을 해결하는 원리로서 가톨릭교회의 전통적으로 중시해 왔던 대화의 원리, 보조성의 원리, 인간화의 원리를 제안하였다. 즉 상대에 대한 존중, 경청, 수용을 중시하는 ‘대화의 원리’, 모든 결정에는 사회 집단 중 가장 낮은 수준에서 또 어떤 결정에 가장 큰 영향을 받는 사람의 발언권이 더 존중되어야 한다는 보조성의 원리, 인간의 생명과 자아를 실현이라는 최종 목표로 하는 인간화 원리는 각각 사립학교의 공공성, 자주성, 정체성에 적용할 수 있다고 보았다. 끝으로, 가톨릭 학교 교육의 발전을 위해 교회의 적극적 개입과 학교 설립, 교사 교육 등 실천적 제안을 하였다.

The purpose of this study is to provide theoretical and practical suggestions to move from the antagonistic relationship between publicness, autonomy and identity of religious private schools to the direction of reconciliation and integration. This paper shows that the government's revised private school law has unconstitutional elements that severely infringe on school corporations' right to appoint teachers and parents' right to choose schools, and that serious differences in perceptions of the publicness, autonomy, and identity of religious private schools have led to this conflict situation. This paper also proposes the principles of dialogue, subsidiarity, and humanization, which are traditionally valued by the Catholic Church, as principles for resolving this conflict situation. The principle of dialogue, which emphasizes respect, listening, and acceptance of the other; the principle of subsidiarity, which states that the voice of the lowest level of social groups and those most affected by a decision should be given more respect in all decisions; and the principle of humanization, which aims at the realization of human life and self, can be applied to the public, autonomy, and identity of private schools. Finally, the paper concludes with practical suggestions for the development of Catholic school education, including active church intervention, school establishment, and teacher education.
