본 연구는 범죄학과 법철학의 고전 이론을 현대 AI 기술과 결합하여 수사서류 분석의 새로운 통합 프레임워크를 제시한다. Heinrich-Kirk의 증거우선 전통(1963)과 Engisch의 경합가설소거이론(1956)을 4단계 파이프라인(이벤트 추출, 사건 재구성, 행위자 분석, 경합가설소거)으로 알고리즘화하여, 80년 전에 제시된 원리가 21세기 디지털 수사 환경에서도 여전히 유효함을 입증했다. 방법론적으로 구성요건 충족도 정량화 체계(Fenton et al. 2016 기반 4요소 평가), 경합가설 자동 생성 알고리즘(구성요건별 대안 해석 조합), 결정적 증거 식별 메커니즘(Popper의 결정적 실험 개념 응용)을 제안했다. 발광페인트 국제거래 사기 사건에 대한 탐색적 사례 연구를 통해 이론적 타당성과 실무 적용 가능성을 검증한 결과, 시스템이 "추가 수사 필요" 판정을 내린 것은 AI가 "모든 사건을 유죄로 판단하는 기계적 도구"가 아니라 "증거 상황에 따라 정직한 평가를 제공하는 조력자"로 작동함을 보여준다. 본 연구는 형사소송법 제308조의 자유심증주의 원칙을 존중하면서도 수사관의 의사결정에 객관적 근거를 제공하는 Human-in-the-loop 프레임워크를 구현하여, 수사기관의 디지털 전환을 위한 기술적·방법론적 토대를 제공한다.

This study presents a novel integrated framework for investigative document analysis by combining classical theories from criminology and legal philosophy with modern AI technology. By algorithmizing Heinrich-Kirk’s evidence-priority tradition (1963) and Engisch’s competing hypothesis elimination theory (1956) into a four-stage pipeline, this research demonstrates that principles proposed eight decades ago remain valid in the 21st-century digital investigative environment. Methodologically, the study proposes a constituent element satisfaction quantification system, a competing hypothesis automatic generation algorithm, and a decisive evidence identification mechanism. Through an exploratory case study of a luminescent paint international trade fraud case, the theoretical validity and practical applicability were verified. The system’s determination of “additional investigation required” demonstrates that AI operates not as “a mechanical tool that judges all cases as guilty” but as “an assistant that provides honest assessments according to evidentiary circumstances.” This research implements a human-in-the-loop framework that respects the principle of free evaluation of evidence under Article 308 of the Criminal Procedure Act while providing objective grounds for investigators’ decision-making, thereby establishing a technological and methodological foundation for the digital transformation of investigative agencies.
