정부는 어린이집에 CCTV를 설치하여 아동학대 범죄를 방지하고, 안전한 양육환경 조성을 도모하고 있으나, 보육현장에서는 CCTV 설치에 따른 정보주체의 권리 침해와 사생활 노출을 우려하는 의견이 제기된다. 이러한 상황에서 어린이집 원장이 CCTV영상을 확인하여 법인의 보육교사 담당자에게 사건 보육교사의 근무시간 중 휴대전화 사용에 따른 업무지시불이행을 전달함으로써 그 원장은 개인정보를 목적 외 용도로 이용한 혐의로 기소되었다. 이에 따라 최근 대법원에서는 무죄를 선고한 하급심과 달리 개인정보처리자에 해당하는 어린이집 원장의 행위는 개인정보의 지배·관리권을 이전하지 않은 채 스스로 개인정보를 쓰는 행위로 개인정보인 CCTV영상을 이용한 행위에 해당한다고 판단하였다. 이에 본 연구에서는 사건에 대한 각급 법원의 판결과 함께 유사사례를 분석하여 사건에서의 법리적 검토와 쟁점을 규명하였다. 이를 토대로 개인정보보호법에서 개인정보 이용의 의미를 파악하여 개인정보 침해를 방지하는 한편, 개인정보의 처리 및 보호를 강화하여 정보주체의 권리를 보호하는데 필요한 기초자료를 제공했다는 점에서 연구 의의가 있다.
