(연구배경 및 목적) 우리나라는 현재 2025년 초고령사회 진입에 따른 인구 구조 변화, 장애인 자립생활에 대한 수요 증가와 같은 다양한 사회 구성원의 사회 참여 및 권리 보장에 대한 목소리가 높아짐에 따라 자연스레 유니버설디자인(Universal Desing)에 대한 관심도 더불어 증가하고 있다. 그러나 국내 유니버설디자인 관련법은 매년 개정되고, 새로운 법률이 발의되고 있으나 아직 주 수요계층의 체감율은 그에 미치지 못한다. 또한 관련법이 대상별로 세분화 되어 있어, 소관 부처가 각각 다름으로 인해 빈틈과 격차가 발생하는 등의 문제가 발생하고 있다. 이에 따라 유니버설디자인 정책 수립의 고려 요소로 작용하는 ‘지형’, ‘문화’, ‘인구’의 특성이 우리나라와 유사한 국가를 선정하여, 관련 법률을 분석하고, 우리나라의 유니버설디자인 관련 법률을 비교하여, 국내 유니버설디자인 정책이 어떠한 방향으로 나아가야 하는지 제시하고자 한다. (연구방법) 이론적 고찰을 통해 유니버설디자인의 개념과 특징, 국내 유니버설디자인 도입부터 현재까지의 정책적 역사를 파악하고, 이어서 '지형', '문화', '인구' 측면에서 유사한 국가를 객관적 근거를 바탕으로 선정한다. 문헌 조사를 통해 선정한 국가의 법률을 분석하여 국내 관련법과 비교 및 분석하고, 도출한 결과를 바탕으로 국내 법률의 한계점과 발전 방향을 제시한다. (결과) 일본, 대만, 스페인의 법률을 비교한 결과, 대만은 우리나라와 유사한 법률 체계를 시행하고 있으나 소관 부처가 일원화 되어 있고, 일본은 우리나라 및 대만의 체계를 넘어 물리적 환경 구축 분야에 있는 관련법들을 하나로 통합하였다. 스페인은 이보다 진화해, 유니버설디자인이 물리적 환경을 넘어 디지털, 서비스, 제품 등 전 범위에 적용할 수 있도록 행정부처가 아닌 국가 원수가 관리할 수 있는 법을 제정하였다. (결론) 향후 우리나라의 사회 및 인구 변화에 대응하기 위한 유니버설디자인 관련 법률을 수립하기 위해선 현재 적용 대상별로 상이한 법률 체계를 정비하고,‘장애인’중심의 ‘물리적 환경’을 넘어 일상의 모든 범위에 연속적이고 통합적으로 유니버설디자인을 체감할 수 있는 법률을 마련하여야 한다.

(Background and Purpose) Interest in universal design is naturally increasing in Korea owing to the growing public demand for social participation and the rights of various members of society. This demand arises from changes in the population structure and the increased need for independent living among people with disabilities. However, while domestic laws related to universal design are revised annually, and new laws are proposed, the level of satisfaction among the main target group has not yet reached the desired level. Furthermore, related laws are divided by subject, which leads to issues such as gaps arising from the different ministries in charge. Accordingly, by selecting a country similar to Korea in terms of the characteristics of "topography," "culture," and "population," which act as factors to consider in establishing Korea's universal design policies, analyzing related laws, and comparing laws related to universal design. (Method) The concept and characteristics of universal design, as well as the history of its implementation in Korea, were analyzed through theoretical considerations, along with previous studies. Subsequently, logical criteria were used to select countries suitable in terms of “topography,” ”culture,” and ”population.” The laws of similar countries were then examined and analyzed in the literature. Additionally, based on the derived results, the limitations and directions for the development of domestic laws related to universal design are presented in comparison with the domestic laws. (Results) After comparing the legal systems of Japan, Taiwan, and Spain, it is evident that Taiwan shares similarities with Korea in terms of its legal system. However, Taiwan has unified, competent ministries. Japan has taken a step further by integrating relevant laws into the field of physical environmental construction. On the contrary, Spain has built upon this progress and enacted laws overseen by the head of state rather than the administration. This allows universal design principles to be applied not only to the physical environment, but also to digital services and products. (Conclusions) To address future social and demographic changes in Korea, it is necessary to reorganize the existing legal system and establish laws that encompass universal design beyond the scope of the "physical environment" and the focus on the "disabled." These laws should cater to various environments, including services and ensure the continuous and comprehensive implementation of universal design principles. Furthermore, it is crucial to establish laws that consider the needs and experiences of users.
